Under the condition of planed economy, it doesn't adapt itself to the development of the cause of environmental protection by solely depending on government and lack of market regulation. But in the market economy, China's environmental market laws, regulations and policies and measures imperfections, it seriously hindered the development of the environmental protection market. This is not the denial to the government-dependent eironmental protection. Instead, it plays the double role of market and government based on the laws and mechanism. In this way, can the public take part in the market of eironmental protection, realize the commercialized evironmental protection, and ensure the objective of environment treatment and the economic development of the society.In the process of the commercialized evironmental protection, the goverment should perfect the legistation procedures and formulate laws and regualtions. What is more, we should give full play to the market mechanism promoting the evironmental protection, and create a political environment for the commercialized evironmental protection. At the same time, we had better abide by the objective laws that economy develops, build a system of macroscopical policy adjusting control on the evironmental protection. Under the guide of government policy, the public will be available to the commercialized evironmental protection. However, any market party should compete fairly and legally within the regulated government laws, build and perfect the market competing regulations and laws, strengthen the supervisal and control on the market economy. All these are the basic requirements for ensuring and sustaining the fair competition of the commercialized evironmental protection.Chapter two is the theoretical foundation and concrete embodiment of the commercialized evironmental protection. It is of great importance to dicuss the sustainable development for the evironmental protection laws and commercialization under the current situation. It will play the important guidance role in the legislation and enforcement of the law. According to the specific requirments of the commercialized evironmental protection in China, we should fully enforce the law, exert the fuction of public opinion, build the environmental information network, and respect the rights of evironmental protection in order to realize the sustainable development of society and the commercialized evironmental protection. The goal of the commercialized evironmental protection in China is to achieve the optimal coordination in different interest subjects by the legal regulations, and to explore the rational rules of adjusting interest relations. The case is that enviromental laws are trying to adjust the interest conflicts between the industrial capitalist and the common people, which were caused by the industrial pollution.
