Study On Legal Problems Of Prevention And Control Of Rural Domestic Refuse Pollution In Taijiang County

Recent years, the government of Guizhou province has proposed some strategies which acts on speeding up the pace of economic development to strengthen Guizhou, and the rapid growth has benefited from them a lot. However, the accompanying environment problems of the rural area increasingly protrude. Among them, the daily life garbage pollution’s prevention and control are extremely prominent. In order to implement the promotion of “Beautiful China” which is written in the 13 th national five-year plan, and also achieve a healthy and sustainable development on the economic and social aspects, the great importance has attached to deeply solving the rural life pollution’s prevention and control. Therefore, the following thesis takes Taijiang, lies in the southeastern Guizhou, as the object of empirical study, and investigate at Shidong Town and Geyi Village. According to the on-the-spot survey, the thesis gives three corresponding legal advice.Firstly, in the legislative dimension, there are number of laws and regulations about environmental protection, but few of them involve in environment problems of the rural are. So as to no rules to obey, when the work of environment protection of rural area is launched. The drafting and changing these laws and regulations should comply with the principles of reducing generalization, abolishing formalization and executing easily.Moreover, it suggests that the government of Qiandongnan Prefecture introduce several autonomous policies and separate regulations on preventing and controlling the rural life garbage pollution problems.Secondly, in the enforcement dimension, it provides a strong guarantee for prevent and control the rural environmental problem by increasing financial input, establishing environment protecting institution, educating the law enforcement officials, increasing the member of law enforcement officials and intensifying the law enforcement efforts. Therefore the situation of enforcement of environment protection of Taijiang, including shorthanded, law enforcement loosen, will be improved.Thirdly, in the law-abiding dimension, the underdeveloped local economy, the unimpressive legal awareness of the native, and the shortage of personage and propaganda skills,etc,lead to the legal compliance situation of Taijiang’s rural areas is not that optimisitic. So, the author suggests that it is better to build up a good atmosphere of law-abiding, and enhance the rural residents’ legal awareness. all kinds of rational and effective approaches are neccesary. Besides, the authority of the Miao people’s village chieftain should be taken into consideration. To communicate and conduct with the village chieftain can help mobilize the native ’ s enthusiasm of preventing and curing the life garbage pollution issues.Related to the rural residents’ health, the sustainable development of ecomomy and society, and the native people’s offsprings, the problem of preventing and curing the rural life garbage pollution becomes the utmost important stage of environmental protection. Facing with the gradually worsened living enviroment, we must take judicial actions to provide a strong ensurance for the rural environmental protection.
