The trend of economic globalization has been gradually spread into the whole world since 1980s. The development of economic globalization has drastically promoted the globalization of education, especially of the higher education. Sino-foreign Cooperative higher Education has been come into being since the globalization of economy and education. As a WTO member from Nov., 2001, we have done the limited opening of our education market in terms of relevant provisions and the implementations reached at GATS. By the end of 2007, with regard to"the Sino-foreign Cooperative Education Rules"and its implementation approach, 23 institutions of Sino-foreign Cooperative higher Education and 119 projects of it have been approved and established. As a new thing, we should develop our research on Sino-foreign cooperative higher education due to its limitless discovery.The education globalization has aroused many new features from the traditional educational mode, including the development of cross-border education and that of cooperative education. And cross-border cooperative education is the distinguished feature of international exchanges in education. In this situation, China has also offered a series of incentive policies to guide the formulation of education field. There has been a great improvement of educational mode, level and scale during these 30 years. Hence, the promotion of this kind of education style has made great contributions to the introduction of high-quality foreign educational resources, to the adoption of effective teaching and managing experience, to the cultivation of talents in economic constructions, to the international exchanges and cooperation in education.In order to adapt to the new situation of WTO and to expand the international exchange and cooperation in education, China issued"Implementation Rules for Sino-foreign Cooperative Education"to standardize laws and regulations of Sino-foreign cooperative education in 2004 after the issue of"the Sino-foreign Cooperative Education Rules"in 2003. On the grounds of the stricter requirements of legal system in our education, the present rules and regulations have shown their weaknesses. This paper is mainly devoted to the legal issues of Sino-foreign cooperative higher education from the legislative point of international and domestic environment, aiming to be helpful for the development of Sino-foreign cooperative higher education by solving these existing problems.
