Thanks to the economic globalization, Sino-foreign cooperatively-run schoolshad a rapid growth as a practice of Chinese transnational higher education. Byabsorbing the advanced foreign educational resources, philosophy and mode, theyhave played a positive role in promoting the development and reform of Chinesehigher education. By the end of2013,1700cooperatively-run institutions and projectshave been qualified and implemented with the administrative approval. After enteringthe WTO, China has made some commitments in terms of educational service tradeunder the rules of WTO and GATS. But the Education Law of the People’s Republicof China has clearly stipulated that education is a non-profit public welfare.Consequently, those commitments made to WTO have not only brought China’seducation a series of new situations but more challenges to Chinese legislation system.Therefore, it remains a crucial field for us to research how to improve the legal systemof Sino-foreign cooperative education by ironing out the disputes betweeninternational laws and Chinese laws.The thesis, starting with the history of Chinese transnational higher education,discusses the current situation of Sino-foreign cooperative education and problems inits recognition, educational system and legal supervision. It then analyzes the legalprinciples of Sino-foreign cooperative education so as to connect with the currentlegislative authorities and legal countermeasures and suggestions in the followingchapters. Classifying the current legislative authorities helps to clarify the relevantregulations of Sino-foreign cooperative education. Based on these analyses, the thesiselaborates on the six legal problems of Sino-foreign cooperative education andproposes some legal solutions and suggestions in the last chapter.
