The Study On The Legal Issues Of Cooperation In Higher Education

Since accession into WTO in the year2001, China promised to open up our education market gradually. The advancement of globalization has pushed our higher education to progress, therefore Chinese-foreign education cooperation has reached a new phase. Diversity in education methods and developments in size, level and mode have played a positive role in the introduction of excellent foreign experience in management and teaching fields and improved our higher education. According to" Articles of Chinese-foreign Education Cooperation" and its "implementation methods", by the end of2013, there were nearly2300Chinese-foreign cooperative education institutions and Chinese-foreign cooperative education programs in higher education. We have made great efforts in developing Chinese-foreign cooperative education and primarily established "Articles of Chinese-foreign Education Cooperation" and its "implementation methods". However, we also faced lots of legal issues in our implementation. Therefore, after analysis of the reality of Chinese-foreign education cooperation and its legal issues, the paper focus on developing our legislation with the expectation that our Chinese-foreign education cooperation more in accordance with the needs of international education from an international and global view.This paper is written to solve the problems such as education sovereign, lag of theory about opening up international trade and services, lag of domestic education legislation and conflict between domestic law and international law. Through learning good experience from the developed countries including UK, US, Australia and Hong Kong, we will establish the education sovereign development concept and hold on to its divisibility and level, amend the relative education regulations, taking the "Chinese-foreign education cooperation going-out strategy" into account, to improve our Chinese-foreign education cooperation system and make it better develop.
