Study On Legislation Of Carbon Emission Trading In China

Atmospheric ecosystem imbalance is a direct cause of global warming, in the case of atmospheric ecosystem unclear property rights and lack the necessary management measures, greenhouse gas emissions are almost at the free use of atmospheric environmental capacity, its cause was external diseconomies borne by the other public. To solve this problem, it should be external diseconomies of greenhouse gas emissions internalized, so that emissions are responsible for. Carbon emissions trading is to control greenhouse gas emissions for the purpose of achieving the mandatory or voluntary greenhouse gas emission reduction quantified and given its product attributes, and it has a value in the market circulation, stimulate the emission reduction targets under the premise of ensuring realization independent emission reduction capabilities. So whether it is from the energy conservation, ecological civilization construction of the angle of view, or from the promotion of economic development and environmental win-win model point of view, how to build China’s carbon emissions trading system have a strong legal research value and practical significance.This paper studies the problem of emissions trading legislation of the carbon core, combing through our existing laws, regulations and departmental rules and regulations, analysis of China’s carbon emissions trading legislation in the problems, the EU and other countries on the basis of learning and legislation related system design features on the proposed concrete ideas to build China’s carbon emissions trading legal system.The innovation of this paper lies in:first, the legal status of greenhouse gas is analyzed, and demonstrates the legal basis for the country to control greenhouse gas emissions; secondly, combined with the developed countries such as America and Europe Union and the area to the legislation and the practice of the carbon emissions trading, the proposal of building a legal system of carbon emissions trading and the concept of the basic principle; finally, combined with global vision of international cooperation on climate change and its present situation, from the two aspects of China’s carbon emissions trading legislation, local legislation and practice experience of pilot analysis of China’s carbon emissions trading system, and to China’s establishment of a Chinese characteristics and international carbon emissions trade legislation put forward countermeasures and suggestions.
