Since the reform and opening up,with the rapid development of the national economy,people’s lives have been increasingly improved,and various environmental problems have emerged incessantly.The domestic garbage closely related to the people is also a major pollution problem affecting the daily life of the residents.The problem of “garbage siege ” is plagued by Urban public life.According to the National Bureau of Statistics,the statistics on the amount of domestic garbage in China in 2017 are 215.509 million tons,ranking the highest in the world.At present,the traditional governance model has been unable to exert greater benefits.Most of the domestic waste disposal is paid by the government.Only the urban residents and units are charged a small amount of garbage disposal fees.Most of the government subsidies are subsidized,and they are also responsible for garbage.Governance of the whole process,management of relevant personnel,supervision of governance effects,etc.,the government burden is getting heavier.The traditional "command-control" administrative management model has been unable to solve the problem of urban domestic waste management.The management and monitoring of domestic wastes will be managed by third-party professional institutions,and combined with the development of the market itself,develop a new model for the management of urban domestic waste by third parties,promote the improvement of domestic waste treatment efficiency,and improve the local ecological environment.In order to make good use of the third-party governance model,we must first establish a reasonable and strict legal and regulatory structure from the legal level,clarify the responsibility of each subject in the governance process,and maintain the overall environment of the third-party governance market and public participation supervision.Less.At present,in the field of third-party governance of domestic waste,China has started relatively late in developing countries,and the overall system has not yet been fully established.It is necessary to conduct in-depth analysis and research on this legal issue and put forward practical suggestions.This paper starts with the basic concept of urban domestic waste,analyzes the current basic mode of third-party governance of urban domestic waste,and selects cases for analysis and discussion.Next,we discuss the analysis of the legal attributes and definitions of responsibilities of government and third-party governance enterprises in urban domestic waste.To sort out the current laws and regulations and departmental regulations on third-party governance of urban domestic waste in China,summarize and analyze the current situation of local practice,and select two small cases to explain.Point out the shortcomings of the current third-party governance of urban domestic waste in China.Compare the third-party governance legislation and policies of domestic urban domestic waste.Select two representative countries,Germany and the United States,to sort out the legal provisions of urban domestic waste involved,and to consult relevant national policies;to study and summarize the enlightenment brought by foreign third-party governance to China.On the basis of the above comprehensive analysis,it puts forward effective measures for the problems arising from the current third party of urban domestic waste management.From the legislative level,improve the current third-party governance regulations on urban domestic waste;improve the corresponding incentive measures;clarify the legal relationship and responsibility between the third-party governance entities of urban domestic waste;and clarify the administrative responsibility of the government in the third-party governance of urban domestic waste;Standardize third-party governance market;strengthen citizens’ participation in third-party governance of urban domestic waste.
