Study On The Legal Regulation Of Classification And Recycling Of Municipal Domestic Waste

The pursuit of a better life makes people pay more attention to the ecological environment.If municipal domestic waste cannot be properly handled,it will hinder urban development,affect the effective allocation of social resources and people ’ s living standards.The attention to the construction of circular economy society makes the research on the legal regulation of waste classification and recovery more urgent.This thesis compares the research and development status of municipal domestic waste classification at home and abroad,combined with the implementation effect of municipal domestic waste recycling work in various places,in order to realize the resource utilization of municipal domestic waste as the goal,from the legislative level,puts forward the legislative principles and legal regulation suggestions of municipal domestic waste classification,in order to further meet the legislative level needs of municipal domestic waste classification,optimize the classification and recycling effect of municipal domestic waste.After years of practice in Japan,Germany and Sweden,there are many valuable experiences in the legal regulation of domestic waste classification and recycling.Their common thread lies in a sound legal system,clear rights and obligations,strict and effective legal liability,and reasonable and complete supporting legal measures.Compared with the legislation of domestic waste management in advanced countries,the legal regulation in this field in China is still in the primary stage.At present,the legal system at the national level is not complete,the local legislation cannot maintain the consistency of norms,the rights and responsibilities of multiple subjects are vague,and the operability is not strong,resulting in bottlenecks in the promotion of municipal domestic waste classification and recycling.On this basis,the path of legal regulation of domestic waste classification and recycling in China is analyzed as follows.The feasible establishment of macro legislative principles,the coordination of legislative system and the improvement of micro specific legal system,we explore the feasible path for the classification and recovery of municipal domestic waste in China: Firstly,the principle of multiple co-governance and the principle of shared responsibility are grasped throughout the improvement of legal regulation.Secondly,the establishment of a national level of specialized law,separate law and local legislation of the legislative system,where local legislation to try regional collaborative legislation and a city a policy combination.At the same time,the rights and obligations of multiple subjects are clarified,the functions of various departments of the government are refined,the right to know,the right to participate and the right to supervision of citizens are clarified,and the responsibility for garbage collection management is clarified for enterprises with producer responsibility.At the same time,the obligation of ’ reporting and publicity ’ is set up to ensure the supervision of residents ’ autonomous organizations.In addition,optimize the relevant system design,such as flexible pricing system of garbage bags,integration of waste picking team.Finally,strict legal liability and multi-means punishment measures are formulated for each participant.Improve the incentive mechanism,mobilize multiple main forces,cultivate the impetus to promote ecological governance.
