Municipal solid waste refers to some waste.These wastes usually appear in our production and life.They have a significant effect on the current environmental treatment.These wastes include recyclable,large,I has flammable,toxic and harmful properties.These gabage not only cause damage to the environment,but also have a bad effect in the lives of residents.In fact,the garbage generated in these lives has its own value.Therefore,we need to use our initiative to make reasonable use of these resources.At present,the treatment of domestic garbage is very important in the government's work plan.The quality of garbage treatment also affects urban development.It is not only related to the current livelihood issues,but also occupies an important position in the city's work to achieve sustainable green development.We have observed the measures of domestic garbage disposal in western countries,and we can see that the first solution to the environmental problems in China is to achieve effective classification of domestic garbage.To achieve effective waste management,the efforts of the government and society alone are not enough.We urgently need to establish a sound legal system for environmental treatment and waste classification.This article,when consulting relevant materials and searching various documents,found that China's existing waste classification and treatment system is relatively lacking.At the same time,the academic community pays less attention to local legislation on waste classification and does not spend energy on academic research.The classification of garbage as a starting point,combined with the concept of economic development,and adapting to local conditions,analyze and explore the legislative situation in the pilot cities.Combined with the practice of the early classification of domestic garbage in China,we made a full comparative study of the differences between the legislative experience of western countries and China,summarized the disadvantages of local legislative practice in China,and discussed the situation of urban domestic garbage classification from the perspective of law.Defects in legislation: the legal ranks have begun to improve,local government regulations have been replaced by local regulations,the legal provisions are unclear,and the legislative work is difficult to advance.It expresses doubts after the legislative work is carried out,and how to distinguish it in the waste classification work.Citizens' rights and obligations,how to define the subject of rights,the subject of responsibility,how should we classify in the legislation,after the legislation is implemented,how can we make reasonable punishment for violations of laws and regulations.In this writing,after collating relevant legal literature,I found that China currently does not study the classification of domestic waste from a legal perspective.There are few books on waste classification legislation.The number of studies on domestic waste classification legislation is not large,most of them are periodicals.The text of the journal is limited,so it is inevitable that the research is not deep.Moreover,the writing logic of many articles mainly revolves on comparison with the legislation of Western countries.It is not specific in making relevant suggestions,and it is not straightforward.The specific analysis is carried out by combining comparative analysis,empirical analysis and literature research methods.These issues are prominently related to China's incomplete legal system,which is covered by the central and local governments.We need to use the legal system as a powerful weapon in our domestic waste classification work,and do our best to achieve harmless governance,and promote the practical realization of legal norms and national policies.
