Research On Local Legislation Of Domestic Waste In Nanjing From The Perspective Of Urban Governance Modernization

The modernization of city governance not only includes the transformation and expression of the top-level design of national governance,but also undertakes the specific implementation of grass-roots governance policies.It is the basic path to realize the modernization of governance within the city.The solid waste disposal dilemma represented by the phenomenon of "garbage siege" is a prominent environmental disease that restricts the rapid urbanization process in my country,and greatly hinders the effective improvement of the modernization level of urban governance.Nanjing is a big city in the Yangtze River Delta region,and the problem of domestic waste disposal has always affected the healthy development of the city.In order to realize the efficient management of domestic waste in Nanjing,the "Regulations on the Management of Domestic Waste in Nanjing" was officially implemented in November 2020.Various types of local legislation,including local legislation on domestic waste,are affected by the level and scope of legislation,and are also subject to multi-dimensional factors such as the uneven quality of legislators,unbalanced regional economic development,and differences in the institutional environment.,but the quality of legislation is often criticized.Taking this as a starting point,using the modernization theory of urban governance as a research tool,a comprehensive review of the local legislation on domestic waste in Nanjing,which has been implemented for more than a year,discusses its existing problems and puts forward corresponding improvement ideas,so as to improve the domestic waste in Nanjing.Improve the quality of local legislation,and then promote the modernization level of municipal governance.The requirements of the modernization of urban governance for local legislation of high-quality domestic waste are reflected in three aspects: legislative concept,legislative content and legislative procedure.By comparing the "Nanjing Municipal Waste Management Regulations" and its main formulation basis,and then systematically sorting out the evolution of Nanjing Municipal Municipal Waste Local Legislation,combined with the current situation of Nanjing Municipal Government.It is analyzed that there is an imbalance in the allocation of rights and obligations in the scientific concept of legislation,and it fails to effectively implement the concept of "no waste city";in the systemization of legislative content,the operability is not strong and the system innovation is insufficient;in the legalization of legislative procedures Public participation mechanisms,legislative incentive mechanisms,and long-term post-legislation evaluation mechanisms are all lacking.In order to improve the "Nanjing Municipal Waste Management Regulations",summarize the advanced domestic waste legislation and law enforcement experience outside the region,and put forward the following optimization ideas from the perspective of the modernization of municipal governance: In strengthening the scientific concept of legislation,in addition to following the voluntary fulfillment of obligations by citizens In addition to the main force and the promotion of national coercive force,the concept of "no-waste city" must be implemented in legislation,so as to truly realize the reduction of domestic waste,and at the same time,the competent departments should be clarified to focus on prior adjustment.In terms of strengthening the systematization of legislative content,on the one hand,the Jiangsu Provincial People's Congress and the Standing Committee of the People's Congress should introduce provincial-level domestic waste local legislation as soon as possible to connect with the legislation of various cities.be fixed to highlight the local characteristics.In promoting the rule of law in legislative procedures,the improvement of the public participation mechanism requires expanding channels to protect citizens' right to know,strengthening the rigidity of the public participation system,and realizing a two-way positive interaction of legislative work;the improvement of the legislative incentive mechanism should aim at improving the quality of legislation,and strengthen the Incentives for staff and entrusted drafting agencies;the establishment of a long-term mechanism for post-legislation evaluation requires the establishment of an evaluation early warning period system to solve the problem of selection of evaluation timing,and quantitative analysis of evaluation work to improve evaluation results.
