The Research On The Public Participation In Classified Treatment Of Municipal Solid Waste Legal System

The growing reality of "garbage besieged city" forces people to actively seek effective solutions to solve the problem of urban domestic waste.Classification of municipal solid waste,waste reduction,reuse,resource has become an inevitable choice.Shanghai,as a national demonstration city of compulsory waste classification,points out that the residents’ consciousness is out of touch with the actual action,and the community main body fails to play its due role when summarizing the main problems of urban domestic waste classification.These two points bring great resistance to the progress of waste classification.However,the problem of municipal solid waste has the characteristics of wide range,integrity and complexity.It needs the largest range of public participation in the classification and treatment of municipal solid waste,in order to achieve the standardized and orderly treatment of municipal solid waste.Starting from the contradiction between the compulsory waste classification obligation and the passive public participation,this paper aims to achieve the ultimate goal of the public’s active participation in the classified treatment of urban domestic waste rather than the passive management of the government,flexibly uses the methods of literature analysis,comparative analysis and empirical analysis,through the analysis of the current constitution of public participation in environmental governance and the laws on the classified treatment of urban domestic waste.At the same time,combined with the successful experience of the relevant systems in the United States and Japan,from the basic principles of public participation in the legal system of municipal solid waste classification,the scope of participation,the procedures,methods,relief ways and environmental protection Information disclosure system,household waste classification management responsible person system,supervision and inspection system and other aspects of beneficial improvement.Public participation in the research and application of the legal system for the classification and management of urban domestic waste,and the orderly participation of the public in the classification of urban domestic waste,can ultimately achieve the harmlessness and resource utilization of urban domestic waste,and also promote the ecological environment management system and governance capabilities.Modernization and construction of a beautiful China provide more solid theoretical and practical support.
