Research On The Subjects Of Local Government Environmental Administrative Law Enforcement

As a very important link in environmental protection,environmental law enforcement carries out administrative punishment,supervision and management for all violations of environmental protection laws and regulations according to law,so as to effectively prevent and control regional environmental pollution.As the most direct,effective and powerful means to combat environmental violations,grass-roots environmental law enforcement bears the main responsibility in dealing with environmental violations.Grass-roots environmental law enforcement departments are the main implementers of environmental law enforcement administrative acts and shoulder the vast majority of environmental management work in China.This paper will take City A as an example,based on the theory of responsible government and the theory of collaborative governance,firstly define the concepts of environmental administrative law enforcement and grassroots environmental administrative law enforcement,and then introduce the current situation of environmental administrative law enforcement in city A,and use the case Analysis method,literature analysis method,and questionnaire survey method extract the existing problems in the process of grass-roots environmental administrative law enforcement in city A,and find that the current grass-roots law enforcement in city A still has unclear rights and responsibilities of law enforcement departments,imperfect law enforcement management mechanism,and poor quality and ability of law enforcement teams,the law enforcement work process is not rigorous,the public awareness of environmental protection is poor,etc.At the same time,through the problem to explore the reasons for its existence,it is found that the main reasons are that the law enforcement management basis is not perfect,the law enforcement management system is difficult to implement,the law enforcement team building ability is low,and law enforcement is not effective.The supervision and publicity of environmental protection are low,and then this article draws on the relevant experience of grassroots environmental administrative law enforcement at home and abroad,and summarizes the feasibility of grassroots environmental administrative law enforcement.Finally,it mainly focuses on improving the law enforcement management basis,promoting the implementation of law enforcement management systems,and the countermeasures and suggestions for improving the environmental administrative law enforcement work in city A are put forward from the four aspects of law enforcement team building capacity and strengthening law enforcement supervision mechanism.Through this research and analysis,this article hopes not only to provide an effective reference for the improvement of the specific work of environmental administrative law enforcement at the grassroots level in City A,but also to serve as a reference for other grassroots environmental law enforcement work in China.
