| In 2019,the ecological protection and high-quality development of the Yellow River Basin has become a national strategy,and the central government and the nine provinces and regions along the Yellow River attach great importance to the ecological protection and ecological management of the Yellow River Basin,and Gansu Province has also taken a firm step towards the management of the basin.With the establishment of the ecological protection and high-quality development strategy of the Yellow River basin and the introduction of the Yellow River Protection Law,it not only brings new opportunities for the economic and social development of the Yellow River basin,but also presents new challenges for the current ecological management.In recent years,the increasingly serious water resources problems in the Yellow River Basin have attracted much attention from the governments at all levels in China and a lot of human,material and financial resources have been invested in their management.Among them,industrial water pollution is an important factor causing the destruction of water resources.Gansu section of the Yellow River basin is a vast area,and there are obvious differences between regions.In the face of complex industrial water pollution management in the Gansu section of the Yellow River Basin,the traditional model alone cannot solve the current problem.Based on the ecological protection and high-quality development of the Yellow River Basin,it is necessary to analyze the current legal situation of industrial water pollution management in the Gansu section of the Yellow River Basin,taking the current problems faced by the Yellow River Basin as a guide.We also draw on the experience of industrial water pollution management in typical foreign basins,and innovate and improve the legal protection system of industrial water pollution management in line with the characteristics of the Yellow River itself in terms of special legislation and institutional design to ensure the high-quality development of the Yellow River basin.The first part of this paper starts from the connotation and relevant characteristics of the Yellow River basin and industrial water pollution,analyzes the socio-economic development status and pollution status of Gansu section of the Yellow River basin,and on this basis,briefly outlines the environmental rights theory,collaborative governance theory and green development concept involved in this paper.The second part introduces the legal status related to industrial water pollution management in the Gansu section of the Yellow River Basin from two aspects,namely,the current status of legislation and the current status of institutions,respectively.The third part examines the dilemmas encountered in the process of industrial water pollution management in Gansu region.The main problems are related to the unsound legal regulation system,the problems of industrial water pollution management system,the immaturity of collaborative governance mechanism and the unsound mechanism of green financial instruments to help industrial structure transformation,which all restrict the effect of industrial water pollution management in the Gansu section of the Yellow River Basin,and also have important significance for the research in the latter part of this paper.In the fourth part,we study two representative river basins,the Rhine River Basin in the United States and the Thames River Basin in the United Kingdom,and hope to obtain experience from them to provide recommendations for industrial water pollution management in China.The fifth part is a demonstration of the results of the previous study.In addition to improving the corresponding legal regulation system,improving the system of industrial water pollution management and collaborative management mechanism,it is also necessary to fill the legal gaps of green financial instruments and establish a green financial information sharing system in order to sound the role of green financial instruments in helping the industrial structure. |
