Research On The Operation Mechanism Of China’s Marine Ecological Environment Law Enforcement Coordination System

The proposal and practice of the strategy of maritime power and the concept of offshore economy have put forward higher requirements for the law enforcement capability of the marine ecological environment,while the functions and powers of coast guard agencies and other sea-related law enforcement forces overlap,resulting in obvious problems of work connection,cooperation and assistance,affecting the quality and efficiency of law enforcement.In addition,at present,pluralistic coordination has become the mainstream trend of environmental governance at home and abroad,and the construction and improvement of marine ecological environment law enforcement coordination institutional mechanisms have gradually attracted attention from all walks of life.At present,there is still a lack of specialized and systematic in-depth research on the coordination of law enforcement of marine ecological environment.Based on the theory of collaborative governance,holistic governance theory and actor network theory,this paper uses the grounded theoretical research method to empirically analyze 191 laws,regulations and policy documents related to the coordination of marine ecological environment law enforcement,and constructs a theoretical model of the operation mechanism of the collaborative system of marine ecological environment law enforcement composed of normative mechanism,coordination mechanism and safeguard mechanism through the three-level coding of open coding,spindle coding and selective coding.Taking this as the starting point,this paper reviews the current situation of system construction and operation practice,summarizes the problems of confusion and low popularity of relevant norms in the normative mechanism,insufficient implementation of law enforcement coordination responsibilities in the coordination mechanism,and lagging construction of the law enforcement coordination platform mechanism in the safeguard mechanism,and analyzes their specific performance and reasons in social coordination,departmental coordination and regional coordination.In view of the above practical problems,some targeted proposals have been put forward to revise legal norms and strengthen legal popularization guidance,innovate and standardize law enforcement linkage coordination mechanisms,and establish and improve law enforcement coordination platform mechanisms.While enriching the research results related to the coordination of marine ecological environment law enforcement,it also deepens the application of grounded theories in the field of environmental law.
