Study On The Rights Of Peasant Workers

The problem of migrant workers is a special phenomenon which is accompanied by China's economic development and social transforma-tion. Due to the acceleration of modernization, urbanization and the changes in rural production mode, a large number of rural surplus labor surged into cities to participate in jobs such as construction and urban services, of course which are in non-agricultural works. But the changes of migrant workers'life field and the nature of their work do not change their status as farmers. Because of the long-standing urban-rural dual structure, there are great differences between urban residents and rural residents'social rights. Although Migrant workers live and work in cities, they can not enjoy the same social rights of urban residents, resulting in a lack of the rights of migrant workers.It is the justice demand of modern society to maintain all the rights tied to citizenship and to provide free and fair social life status to all social groups. It is also the internal requirements of a harmonious society and scientific development to protect their rights, to break down barriers between social groups and to guarantee them the same social rights with other groups. Migrant workers, firstly, as social citizens, enjoy human beings' natural rights, whose personality, freedom, property should get social recognition and respect. Secondly, as social partners who have contractual rights, they are entitled to share the benefits of social development, and they are also in prior status in the interests of the distribution of interests in system design; Finally, with the welfare rights of vulnerable social groups, they should be provided with humanitarian concerns.Rights of migrant workers in real life is mainly reflected as labor rights, the rights of political participation and having access to social welfare and public services. Concrete realization of these rights directly determines the quality of migrant workers'life and social status. They guarantee the cornerstone of migrant workers in social life.There are many difficulties in realizing the rights of migrant workers in China. Main reasons include:structural differences between urban and rural systems mainly caused by the household registration system; imperfect legal system related to the rights of migrant workers; flawed government functions for migrant workers; widespread discrimination against migrant workers, and even a certain degree of discrimination culture; social organization of migrant workers is not sound. To break through all these obstacles, and fully guarantee the legitimate rights of migrant workers and to build a justice society based on fairness, we must take positive and effective measures, in aspects of law, government and society, to build three-dimensional maintenance system. We must build a comprehensive social security system, which improves their labor skills and comprehensive quality, strengthens their labor rights' protection, and gives them equal basic public services. At the same time, we must actively promote the reform of household registration system, guarantee migrant workers' rights of democratic management and democratic elections, protect migrant workers' land rights, make tremendous efforts to protect migrant workers' rights, implement the national strategy of migrant workers nearby employment and strengthen and improve the management and services for migrant workers. Only by taking multi-dimensional measures can we transfer migrant workers'appeal to rights to real life rights, and consequently promote social justice.
