Research Of Chinese Procurator's Professional Ethic System

Procurator's ethics nonns is an important part of legal ethics and judicial system, it is the requirement of procurator's constitutional position and the new stage of ruled by law to strengthen its research. It concerns about procurator's subject, function, quality of law enforcement and social justice.This article bases on perspective of "realistic ruled by law", insists on optimization of procurator ethics norms and research on related details. The logic path is "Theory discussion-Text analysis-System perfection"; each chapter describes both theoretical and practical issues. The basic view of this article is to optimize procurator's ethics norms, and proposes some new ideas.In the first part, this article logically investigated the concept of ethics, morality, professional ethics and ethics norms. Three functions of ethics norms are concluded as assessment, education, bind and inspiration. Based on "Internal and External Cause", the functions of ethics norms towards subject initiative are analyzed.In the second part, it researches on the basic theory and Sollen essence of procurator's ethics norms. This article analyses the connotation of legal ethics and procurator's ethics, compares it with lawyer and judge's ethics. It proposes three characters of procurator's ethics norms:obvious political nature, multiple ethics areas and higher level requirement. Based on that, it reveals the structure and feature of ethics norms system, the system has multiple origins, several-layer requirement, and obvious enforcement.In the third part, it researches on the ethic norms text. Firstly comes the foreign text, including the American, England, German, French, Japanese, Russia and some international procurator's ethic norms. Based on the analysis of these features, three enlightening ideas are revealed. And then follows the Chinese constitution, law, discipline, policy, norm and guides. The main problems with Chinese procurator's ethic text include:huge number, repeating and conflict, logic disorder, mixed levels, laggard content. It also investigates the norm's execution, refers to the procurator selection, foster of cadre, award, promotion, evaluation and punishment job.At last, ideas about optimization of procurator ethics norms are proposed. Three levels of ethics are divided as:base-line, middle, virtue. Four fields include:political ethics, organizational ethics, professional ethics, individual and social ethics. The text system should contain:disciplinary sanction, rewards principle, codes of ethics. After that, an ethics guideline and a standard of logic, practical and leveled text is created. Directing at norm's application, the concepts of scientific ethic evaluation and alarming system are proposed.
