Research On The Professional Ethics Training Of The Procurator

China's Constitution clearly stipulates that the procurator organ is the legal supervisory organ of our country.The procurator is the supervisor of the law and performs the judicial duties of the procurator organ through the prosecution's handling of specific cases and judicial activities such as the exercise of procurator power.As an important participant in the maintenance of national laws,the prosecutor's professional ethics of the situation has a significant impact,it will ensure that the prosecutor enforces laws impartially,establish a good image of the procurator organ and the maintenance of social justice.However,on the issue of the prosecutor training,in the past our country concerned the prosecutor's professional quality and ignored the quality of the professional ethics of the prosecutor,thus affecting the quality of the prosecutor team training.In recent years,with the vigorous implementation of judicial reform,procurator organs at all levels began to gradually focus on the construction of professional ethics of the prosecutor,which makes our professional quality of the prosecutor has been improved.However,due to the lack of pre-professional ethics training in our country,some drawbacks in the cultivation of professional ethics quality during the tenure period and the lack of supporting mechanism for the cultivation of professional ethics.In consideration of socialist country construction,there still have a certain gap between the status quo of the quality of the procurator's professional ethics and the requirements of the procurator organs.Therefore,it is very important to strengthen the procurator's training of professional ethics quality and improve the overall level of professional ethics of procurator.The quality of the prosecutor's professional ethics is not only an important prerequisite for the procurator to stick to the professional bottom line,but also an important guarantee for the prosecutor to complete the legal supervision duties.The first chapter of this thesis firstly elaborates the meaning of the professional ethics of the procurator and the characteristics of the prosecutor's professional ethics,and then explaining the value of the professional ethics cultivation of the procurator from three aspects: Exercising procurator power according to law,establishing a good professional image and improving the judicial credibility,respectively.Finally,this chapter is analyzes the factors of affect the cultivation of professional ethics of procurator,including family factor,school factor,social factor and economic factor.The second chapter mainly analyzes the form and content of cultivate the procurator's professional ethics.There are three main forms includes pre-service school training before becoming a prosecutor,the regular training of the prosecutor during their tenure and the prosecutor self-cultivation.This content is mainly includes loyalty,people,responsibility,fairness and integrity.The third chapter mainly analyzes the current situation of the professional ethics quality of the procurator in our country.This chapter firstly points out that the mainly problem of the cultivation of the professional ethics of the procurator in our country,including four aspects: The lack of cultivate procurator's professional quality during the period of serving;There are some drawbacks in the cultivation of professional moral quality during the tenure;The lack of self-cultivation of the procurator and the insufficiency of the supporting mechanism of the professional ethics of the procurator.Finally,this chapter analyzes the not enough perfect places in complementary mechanism form three aspects,including the imperfect selection mechanism,unreasonable professional treatment and inadequate prosecution system.In chapter four,according to the above problems,and then based on the Chinese national conditions to explore the ways to improve the professional ethics of the procurator,points out that strengthen pre-professional ethics training of the procurator,to improve the quality of professional ethics during the service of the prosecutor,to establish and improve other supporting mechanisms of the prosecutor professional ethics training,such as choose-and-appoint mechanism,occupational treatment,reward and punishment system and so on.Thus they will enhance the quality of the prosecutor's professional ethics quality and convey the construction of the society with rule of law.
