Since 1980s, social security and its legislation have always been being a focus in the world, Especially in the recent years, the rapid change of economy, politic, social relation lead to the reform of social security system. At the same time, the reconstruction of social security legal system has become the great topic that the doctors of theory and practice of law have to face in the world. In China, people become more and more follow social security reform and its legal building with great interest, the hot issues, which affects the nation's future, benefits the descendants. But for a long time, social security law is not arise to study and build as an independent law and its research far behind the civil and commercial law, Economic lay, and labor law, never meet the need of systemization and reality of social security. The present research is only give some legislative suggestion and thought on the hot issues of social security reform or basically explore some problem about social security systems, still on the stage of ne leaf before the eye shuts out the forests?Not to say deeply study the legal system from the past to Now. But if not historic and rational thought on the social security law system, we can't deeply see through the details of economy, politics and culture of social security legal system, further even entertain no high hopes to build the social security legal system with Chinese characteristics. In view of the above-mentioned facts, This dissertation studies China social security law system from the legal system historiography angles using the system-analyzing, historical, compressive methods, so that practically brings to light and theoretically express the modernized course of China Social Security law system, such as historic origin, motion and barrier, basic principle, development trend and so on. This dissertation consists of introduction, conclusion and seven charters. The introduction gives the scope of social security and the definition of social security legal system, expounds the function of social security, summarizes the model of countries social security of the world, analyses the inner construction of social security system, illustrate the object and method of study of the dissertation proves that China social security legal system is the base building and perfecting the socialist market- oriented economy, is the core of socialist democracy and legal system establishment and the guaranty. Chapter one and chapter two make comparatively systematic research on our country's ancient legal thought of social security and legal measure which haven't been deeply studied in the legal history field until now. This makes us able to observe the historical essence of the modernization process in China's legal institution of social security and developing mechanism of traditional culture against broad historical background. Not divorced from the economic and cultural background of that time , especially after synthetically taking the influence of social environment , economic as well as social policy and system into consideration, they objectively evaluate the legal thought and measure of China's ancient social security and point out that the legal culture legacy of China's ancient social security is the essence of considering the history as a mirror.
