It is basic premise to find and research problem in the vast and profound space of rural collective land systems that farmer's land contracted time remains 30 years. Due to the rigidity of land collective ownership system and the particular national condition of super minor scale management caused by dividing land equally, conform to the historical trend of the time, the transferring of land use right become the claim of agriculture and rural advanced productivity development and the succeed innovation of farm household responsibility system. So go with the tide of development, it turns to be the original intention of this article to researching on the transferring of collective land. Four main problems have been discussed in turn in this article:(1) system is higher than technology. The guarantee of rural collective land system is requirement of sustainable development of agriculture and rural economy. As an important part of rural collective land, farmland is much interrelated to sustainable development of agriculture and rural because of its great quantity and wide dispersion. The farmland system arrangement has also an important meaning and effect to optimization deployment of rural land resource. Look at things dialectically, along with the development of agriculture and rural economy, farm household responsibility system, in the core of farmland system, need to be unceasing consummated and innovated. So how to innovate farmland system become primary problem discussed in this article.(2) The essence of land transferring is alternation and transaction in property right. If it can be said that the system in force of collective land may adapt to the agriculture development stage in which the greatest yield was pursuing and most of farmers have paid much attention to their land, then may it adapt to the new period of agriculture and rural development in which more and farmer expect to transfer their land use right even contracted management right or not? What defects exist in the systems in force of collective land and how to deal with theirs?(3) Land transferring market is composed of the whole land transaction relations. The basic factors of land property right transaction include perfect market system and sound market mechanism. So the third problem in this article is to inspect the system and mechanism of now rural land market and find way consummate them. In addition, market mechanism moving can not deviate form government adjustment, so corresponding institutes of market management is the original implication of market mechanism moving.(4) Along with the economy and society development of agriculture and rural, the trend of capitalization and marketing appear more and more strong in using fa-mland resource. Under the incense caused by compared profit and the land system constrain to taking over for use, appearance in value of farmland resource lead to a number of transferring to non-farm field which is violate the law. How to treat this kind of transaction? Need it to be just blocked up or made dredging and blocking up integrate? Need it to be took regulating measures to correct market disorder and remedy scarcity caused by plan and law regulating measures while conform it to the standard? It is the fourth problem that is to be discussed in this article. Above four problems are closely related. As thebeginning of the whole article, the purpose to discuss this problem is to sort out the main pulse of changes and clear out the orient of innovation in the Farmland system: the next two problems particularly inspect and construct market main body and organization of collective land transference; the last problem inquire into corresponding policies from the angle of economical regulation.
