| In this paper, focusing on the limited property house’s problem, through thedescription about the management dilemma of the limited property house, I want toanalysis the institutional dilemma underneath the surface. In view of the existing theoryon the basis of careful combing, and combined with the existing rural land system reformexploration practice, put forward my views and governance approach of the limitedproperty house’s existing problems.Hope that through this paper’s theoretical analysis ofthe legal transference of the limited property house,we will have an accurate positioningand forecast of rural land system reform in our country.In addition to the introduction, in this paper, the body is composed of three chapters,the basic research ideas are as follows: the first chapter, mainly introduces the conceptdefinition and present status of the limited property house’s problem and the theoreticalcontroversy, and advances my own reflections based on this facts;The second chapter,focusing on the analysis of the legal and institutional dilemma of the limited propertyhouse’s problem,emphasis on analyzing China’s urban and rural land system and landfinancial problems, and introduces and analysis the existing Institutional reformexperiment of land;The third chapter, mainly to response the debates about the limitedproperty house’s problem in the academical theory, and puts forward suggestions to theproblem of the limited property house’s problem and the rural collective land systemreform.The limited property house’s problem is a social phenomenon which is mixed withnumerous disputes of interests, behind it contains the path choice of China’s reform andsocial structure adjustment,and so on.Under the premise of the collective land ownership,taking the rights of use fully into effective use may be a good choice for the reform of theexisting situation, and it may be an optimal choice which is fundamental to solve the problem of the limited property house. |
