Dual System Of Property Rights Theory

The so-called 'double property right system' refers to a property right system under which the two basic elements of production and exchange -material capital and human capital not only are balanced, but also their property rights, especially that of human capital, are fully realized. Due to some complicated objective reasons, all the former property right systems had been 'single' property right system oriented by material capital. However, the evolvement laws of the property right system and the trend of social and historical development show that the role and status of human capital have been improved and the realization of its property right is inevitable.This paper is to analyze the double property right system from three aspects: from history to present, from macro to micro economy and from theory to practice. With the combination of norm and demonstration, logic and history as its basic research methodology, it deeply explores the formation, basic implications, current situation, the basic realization forms and the main restricting factors of the double property right system. The thesis also reveals the essential relations between the double property right system and socialism. In the end, it forecasts the fundamental problems, developing trend and chief measures of Chinese economic reforms.Summarizing the present research achievements, the first chapter defines the primary concepts more clearly and identifies the main problems in this field in order to prepare for the discussion later. Economists refer mainly to the property of material capital before. This thesis adds and emphasizes that the property right consists of two categories: property and right. 'Property' includes two categories: material element and human element, which are defined as material capital and human capital in thisthesis. Material capital is the general term of natural resources and means of production defined by the capital category, whereas human capital property right is labour force defined by the capital property right, namely the labor force property right in the extensive sense. On the level of corporations, human capital right approximately falls into three categories. The distinct features of human property right are high exclusiveness, limited transference and flexible appliance.As a primary economic system, the property right system has its own evolutional law. With the combination of logic and history as the methodology, the second chapter applies the general property right theory to analyze the origins, functions and efficiency of the property right system and to reveal the primary law and trend of the evolution and formation of the system. It can be seen that the formation and evolution of the property right keep to the "negation and negation" law: the public-owned property right system - the private-owned property system - the public-owned property right; the basic trend of evolution and development of the system is from the private-owned property right system characterized as 'single property system'to the public-owned system characterized as'double property right' system. This chapter makes a deep and meticulous analysis of the factors affecting and controlling the development and evolution of the property right system. Additionally, it describes and reveals the gradual promotion and realization of human capital property right based on the solution of the 'mystery of the fortune growth', the general survey on the evolution of enterprises and the analysis of the arrangement and realization of three categories of human capital property right in enterprises.The third chapter discusses the framework of the 'double property right' system.
