The Economic Laws Of The Era Of The Republic Of Development Problems

This paper mainly studies and probes into the evolutionary process, motives various contradictions and historical enlightenment of the economic law of the Republic of China during the particular period of 1912-1949, in order to find the historical origin of the economic law in China, and with an attempt to make clear and explain some difficult problems in the modernizing process of the economic legal system from the perspective of the historical tradition of the development of economic law in China, for law is a cultural phenomenon, the cultural hereditary factors accumulated in its making and development inevitably have a corresponding influence on the development of subsequent laws, and display certain successiveness and dependence in the determination of development course. No one can hold back or resist this natural law of historical development.The reason why China's economic law originated in the Republican Period has its profound historical tradition and historical background. It is not our subjective guess or historical assumption. Therefore, we must examine the development of the economic law of the Republican Period in the broader environment of the social development then, in order to reveal the multiplicity of the relationships between the development of economic law and all the factors of social development, ascertain the major and minor relationships and level relationships between them, and the certain and uncertain relationships between the various factors, and grasp completely and precisely the innate law of the development of economic law. That is to say, we should observe and analyze the social environment of the economic law of the Republican Period from the developmental and relational perspectives, deeply analyze the social conditions and mechanisms of its development and change, and the era features generated therefrom, search for the profound connections between the development process of the economic law in the Republican Period and the motional process of the social basic contradictions, in order to elaborate the reasonableness of its existence and its historical value in social progress.The sovereignty of the Republic of China on the mainland was short, but it was a historical era gradually changing from the old to the new, particularly the development of economic law was in a process of rapid shift to modernization. Summarizing and studying the developmental law and experience and lessons of success and failure of China's economic law in theRepublican Period will not only bring enlightenment from the past, but also of great use for reference for the current socialist construction of economic legal system, especially of help to the scientific and precise understanding of various theoretical problems in the development of the modernization of the economic legal system of our country. This is undoubtedly significant to the object choice of the modernization of economic legal system in China today.
