The idea of fairness, which is ancient and lasting, is the lofty value that people approves generally. But as view of fairness difference, the law is also widely divergent from the fairness it safeguards or pursuing path based on fairness view. Economic law regards fairness and justice in its unique pursues, otherwise it is neither distinguished with other legal departments, nor necessary to become a legal department. This dissertation replies "what is the economic law" from the theory of essential fairness, tries hard to prove that the economic law should be the main legal method to coordinate the macroscopic economy to implement the principle of fairness in the allocation of interest in order to guarantee the people earn what they deserve and pay what they owe. Therefore, we can realize the fairness allocation of interest and safeguards smoothly reform the social stability.The fairness of traditional, civil and commercial law takes the individualism as the instruction, takes abstract personality equality as supposition condition, emphasized equal opportunity and treats impartially. But, the modern society's development causes the enormous difference of ability, wealth mutually. If the law turn a blind eye to these congenital inequality and treats impartially to all people, it would cause inequality to be perfectly justified, even intensifies this kind of inequality. Economic law is quite different. It introduces the essential equality into its own value system, gives dual attention to the rationality both in economical and social significance based on the approval allocation difference, shows its unique humanities concern.
