Philosophical Rethinking On Historical Morphological Evolution For The Law Of Science And Technology

The development of the law of science and technology has a long history, which is the same long as the development of science and technology and plays an active role in maintaining and guaranteeing the development of science and technology, also in opening up the social productivity. However, the development of the theories for the law of science and technology lags behind this. It is until the exuberant springing up of modern science and technology and unprecedented entering the various fields of the society that lead to the tremendous leap of social productivity and trigger the full revolution of social relation. At this time, as a bridge connecting science and technology, economics and social development, the law of science and technology thrust its point outside other law branches and become an independent section law, which make the theories for the law of science and technology acquire certain development.Social practice and reality reveal that the development and completeness of the law should be based on the theories of the science of law. Whether the law of science and technology fully plays roles in promoting, guiding and regulating science and technology depends on our understanding, designing and perfecting the law of science and technology. So, in this thesis, from evolution of historical form of the law of science and technology the generation and evolution have been sorted out and determined for their various historical stages. The author believes that the law of science and technology experienced three evolution forms during its developing process, i.e. technical rules, intellectual property and comprehensive law of science and technology.Based on this, the agent and affect for the generation of historical forms of the law of science and technology has been investigated. It was found that the three forms of the law of science and technology are produced under scientific and technological right and power for a certain science and technological development background. For instance, the scientific and technological law in form of technical rules was formed for the feudal emperors to open up productivity and maintain their position by employing their rights to change popular technical rules into laws. The law of science and technology in form of intellectual property appeared for the interests of main body of science and technology, which is issued to protect the rights of science and technology.
