Reaearch On Society Transtion And National People's Congress System On County Level In Contemporary China

The whole thesis contains five chapters. In chapter one, I research the system of the theoretic origin and the historical foundation of the national people's congress (NPC) through the macrostructure, and it is clear that the foundation of the system of NPC is the product of the human political civilization, the inevitableness of Chinese revolution and historical development and we can see that the foundation of the system of NPC is based on the theoretic origin and the historical foundation deeply. Furthermore, the thesis analyses the foundation and the course of the system of NPC, and also elaborates the development of the system of NPC under the system of planned economy and the period of social transform, which is good for mastering the system of NPC as a whole.The second chapter is regarding to the social transition and the transform of national people's congress (NPC). In the present age the People's Republic of China is in the course of social conversion, so the problems of the right events, the obvious class differentiation, the raising interest applying as well as the developed social participants bring forward a big challenge for the NPC system. Only if the NPC system acclimatizes itself to the social conversion and improves its adjustability and coherence ability by continuously perfecting itself can the NPC system go on developing. In the course of social conversion, we should perfect the NPC system, implement the professional delegates, reform the electing system, realize the equal votes ending, enlarge the range of the direct electing, enhance and improve the task of the delegates, tie up the relation between the delegates and the electorates, so that we can let the NPC reflect the litigation and requirements actively, exert the function of interest expression of the NPC totally and advance the development of the democracy. During the time of social conversion, the running condition of the nation power requests that the supervising function of the NPC should be exerted fully; the running power should be lawful; the relationship between the reigning party power and the nation power should be regulated. And endow the NPC with legal supervising rights to the reigning party. Enhance the rights of supervising and lawmaking from NPC, establish and perfect the law system of the power's supervising and restricting. Set the constitution courthouse; fulfill the supervising rights of the NPC constitution; enhance the supervising rights for the dismissing power of the elected and nominated officials. The fifth section in this chapter is regarding to the special analysis about the changes of the local NPC system that is based on the county NPC during the time of social conversion. During the time of social conversion, the task of appointing, removing and supervising of the local people's congress delegates goes on developing and inclining to standardization, at the same time, the opening quality of the local affairs and the role realization of the delegates become more and more strong.In the third chapter, I take the NPC in the Lan Shan district Lin Yi city as an example to explain the development of the NPC in a county during the time of social conversion. In this chapter, the writer gave a detailed explanation about the development and the practice of the people's delegate in the county by the sensibility and the demonstration materials that come from social researches. It begins from the electing to the authority exertion, the contact with the delegates and the electorates, and the configuration of the standing committee of the NPC.In the forth chapter we analysis the common problems of the national NPC system in the county which we meet in the electing system, the supervising system and the deciding right using time, also in the construction period of the NPC and committee. Accordingly we provide the way that how to perfect the NPC system. In the electing system, because we have many problems such as lacking the neutralism in the electing organizations, plotting the electing area at will, lacking the advanced electing registering mode and the advanced introducing manner of the candidates, having difficulties in ensuring the honesty of the voting electing and so on, so it is necessary to establish a neutral and constant committee, improve the ensuring way of candidates nomination, enhance the competitive and opening quality of electing , plot the quota of the delegates and the electing area reasonably, enhance the equity during the time of voting . In the course of perfecting the deciding rights system of the NPC in the county, we should establish a system such like beginning from party decision making — national people's congress decision—government implement. We should define the range of the decision rights scientifically, establish and strong the implement system concerning the decisions of the NPC, so that the problem of the weakness in the implement of the decision rights can be solved. In the process of supervising rights implement of the national people's congress in the county, we can find many problems such as emphasizing on the styles and despising the actual effects, the strong supervising methods can not be implemented very well. So we must deal with the relationship between the reigning party and the NPC, perfect the supervising procedures and organize the leading position of the NPC, promote the autonomy of the human, wealth, and material of the NPC, realize the supervising mode of NPC according to the law, establish the commissioner system of the NPC, strengthen the budgeting and supervising rights and perfect the voting decision manner of the NPC, enlarge the supervising range of the standing committee of the NPC. At present, during the time of construction of the NPC and the standing committee of the NPC, there are some problems such as the officials in the NPC delegates are excessive, the NPC delegates can not fulfill the duty very well, the delegates are excessive, the deliberating ability is poor, the structure of the component members are unreasonable, the moving system of the organization officials are rigid, the organization settings are not standard and the size of personnel force is rare. So we should enlarge the NPC team, reduce the delegates and the officials in the delegates, establish the delegate fulfill system, optimize the structure of the standing committee of the NPC, set up the NPC working organization and personnel force reasonably and reinforce the NPC working structure system.The fifth chapter is a summarizing chapter, it elaborate on the topic of democracy development is the inner requirement of the socialist system. It also points out that the goal of the NPC reformation is boosting the social democracy. In order to implement the NPC reformation we must insist on that connect the party's leading ship the people's are the masters of the country and administer the nation according to the law together. Then the NPC system will be powerful, the social democracy with Chinese characteristic will go on developing. In this chapter we also review and sum up many theory issues in the researching process of NPC system, at the same time we understand the researching conditions of the NPC system at the present, to be familiar with the problems which we will meet in the course of NPC further development.
