It has got widely attention about the bad claims of the state owned banks (SOBs), because it concerns about our financial safety and even affects the stability of our economy and politics if it couldn't be settled. Cautioned by the financial crisis of the Southeast Asia, China government started to settle the problem of bad claim of the state owned banks after 1998. In 1998, the government issued 270 billions special national debts to supply the capital of the state owned banks. In 1999, more than 1000 billions non- performing loans (NPLs) were separated through the four Chinese Asset Management Companies (AMCs). The reform of the state owned banks that started from late 2003 has been given high expectation weather the administrator or the specialists in the theoretical and practical field.In fact, the status of the bad claims is the token of the degree of claims protection in one country, where we can find the answer that why the state owned banks has so much bad claims and the capital of the state owned banks is serious lack. Then how the claim of the state owned banks is aggrieved, why the legal can't give effective protection and could the problem be solved by the reform of the state owned banks? The paper will give the answers through the study of the claims protection of the state owned banks.This paper will emphasis on the claims protection of the state owned banks and study the problems at the sight of banks. The paper has three parts. The first part is chapter one, chapter two and chapter three, which give the answers of the reasons, the circumstance and the status of claims protection of the state owned banks. The part two is chapter four to chapter seven and this is the mainly part of the paper. The last part is the chapter eight and it gives the conclusion of the paper.
