A Study On The Reform Of Land Law Of Macao

This dissertation illustrates the existed problems of current Land Law of Macao through reviewing and analyzing Macao’s land system history and present situations. By analyzing the reasons of these problems, exploring its root causes, using the advanced experiences of neighboring regions as references. Then reform suggestion on Macao’s Land Law was proposed.Chapter I Introduction. Background and the meaning of selecting this subject, reasons behind selecting this subject and target and orientation of research was introduced in detail.Chapter II History and present situation of Macao Land System. This chapter provides the Macao’s land history, social structure evolution, evolution of Land Law, Sandpaper lease problems, Land Planning System and Land reclamation plan for new town after handover.Chapter III Macao’s basic land system. land circulation system, land p remium system and land acquisition system were reviewed in detail in this chapter, related systems were compared between Macao and mainland, advantages and deficiencies were pointed out in the two systems, so as to learn from each other’s strong points to offset each other’s weakness and conduct reform accordingly.Chapter IV Legal structure of Macao’s land rights. Land structure, land rights, city land planning, rights arising from city land planning and land reclamations of Macao were discussed and analyzed in this chapter.Chapter V Reviewing current land law of Macao. Public’s different opinions on current land law, comments on land cases from social circles, inquiries on land reclamations for new town of the Government etc were summarized to respond to different opinions and voices of Macao different social circles.Chapter VI Approaches and scenario on Macao land law reform. Based on the existed problems of the current land law discussed in the previous chapters and Macao’s local practical situation, and using advanced experiences from mainland and neighboring regions as references, approaches and scenario on Macao’s land law reform was brought forward. It was hoped the new Macao land law can better solve all types of problems, and devote to a more scientific, reasonable, orderly and fair administration to Macao’s land in the future.Conclusion. The viewpoints of this dissertation was summarized, proposal on reform to the current Macao’s land law was generally brought forward.
