The Research Of People’s Mediators In Rural Society

Along with the urbanization process and the "big mediation pattern" are put forward in new century, the people’s mediators group becomes more and more prominent in dealing with rural disputes, and also becomes more and more conspicuous in the role of local social integration, but the research for the group of rural people’s mediators is not enough. This article provides a comprehensive dynamic description from the static aspects of people’s mediators, and gives it a positioning and a development analysis of the rural people’s mediators.The research object of this study is people’s mediators group in rural social, and the research content is its composition and working mechanism. The constitution of people’s mediators group is very complex. There is a discrepancy between the law and the reality. The rural people’s mediators are classified in this study. It is mainly divided into the people’s mediators as judicial office staff; the people’s mediators as government official staff in addition to the judicial offices; the people’s mediators also hold the position of village cadres; the people’s mediators as ordinary villagers and the people’s mediators of employment. Different people adjuster identities determine their different role in the process of rural social dispute resolution. Behind each identity, some specific meaning and information is hidden. Through this distinction, the influence factors behind the surface could be distinguished. Local network is the first factor that impacts the people’s mediators. Some of the local network is natural and dominant; other is the formation of the long life process and hidden. They affect people’s mediators from various aspects. Rural people mediator’s work is combing the local social networks, rather than mediating disputes. People’s mediators are in addition to considering the "face" as relationship network, but also considering the "dot" as human feelings and face in rural society dispute resolution. This research uses scenario analysis method, and conducts a comprehensive dynamic description for the working state of the rural people’s mediators through the analysis of the case.In this study, we provide a role positioning for the rural people’s mediators by using the view angle of local knowledge theory. It adds experiences and materials for rational social perception about rural people’s mediators, and contributes to dispute resolving and order maintenance in rural society, so as to advance the urbanization process of our country. This study also enriched the perspective of rural people’s mediators, increased the experience sample of the legal sociology to fill the research vacancy of the public. I also look forward to sociological empirical research can provide theoretical response to the dilemma of rural people’s mediators.Last part of this study is the prospects analysis of rural people’s mediators. The group of rural people’s mediators as an important force to settle disputes is neither going to disappear nor coming around. It will be gradually separated with the government background accompanied by the process under the rule of law and the change of rural people concept, thus, as a kind of independent power to settle disputes.
