In such a developing country--China,comprehensively pushing rule of law is a kind of extensive and deep revolution in national governance field.For the long run especially from the Third Plenary Session of the 11 th Central Committee of the CPC,our Party deeply concluded the successful experience and deep lessons for Chinese socialist legal system construction which ensure the governing the country according to law is the basic strategy of the Party as well as the basic method to govern the country and politics.Since the 18 th CPC National Congress,the Party even set the rule o law as the basic methods to manage state affairs.Although the cognition already became the agreement of Party,country and academic field,it costs a long and hard process to establish.Marx pointed out that “Each era's theoretical mindset and our era's theoretical mindset are all the history product.But different era generates different forms thus,they possess the different contents.” since Reform and Opening Up Revolution,CPC continuously explore the significance of rule of law to manage state affairs.From enhancing socialist democracy legal system construction to ensuring rule of law as a basic strategy;from forming socialist legal system with Chinese characteristics to establishing socialist legal system;from listing rule of law as the major content of harmonious society to regarding it as the a basic strategy to manage state,CPC how to evaluate the rule of law is the significant issue through these process.From the integrity view,this paper stresses Party's cognition process since Reform and Opening Up policy.Based on the research about Marxism basic theories,it comprehensively applies multiple methods to conclude the significant theories and practical results in this field and promote the role of the cognition in building socialist legal system with Chinese characteristics.This paper include Introduction,Conclusion and six chapters.For the Introduction,it introduces the topic background,comprehensively surveys about the earlier stage relative research results,presents the research basic framework,research features and innovation points.The first chapter recommends the basic concept and relative theories.Regarding the legal government as the historical context as the basic clue,it selects the representative theoretical opinions and analyzes and defines the rule of law and its relative concepts.For the second chapter,the CPC's cognition and practices before Reform and Opening up.This chapter deeply analyze to abolish the old legal institution in early years of the new nation,establish new legal systems,Party's cognition about rule of law before 8th CPC National Congress and Party's circuitous cognition about rule of law as well as conclude the major
