Research On Fugitives Apprehension

Hunt down escaped criminals,which is also referred to as“Fugitives apprehension”is a basic and comprehensive criminal investigation method.It is not only one of the most important components in investigating and handling cases of the public security organs at all levels,but also a basic way to realize the purpose of investigation and litigation.Since the launch of series of national fugitives apprehension campaigns including“clean net”campaign,“fox hunt”campaign,and“sky net”campaign,a large number of fugitives have been chased and arrested.It not only effectively curbed the current situation of the further deterioration of the crime,and improved the social environment,but also struck heavy blows at the overweening arrogance of the criminal suspects,and the functions of investigating crime were fully exploited.However,with the increasing mobility of modern society,the ever-changing information technology,and the unstoppable process of globalization,the escape path,ways,methods etc.taken by the fugitives after the implementation of crime show a developing trend of diversity and uncertainty.There are still a lot of fugitives beyond the arm of the law.It is an urgent task for the Chinese investigators to carry out the pursuit of fugitives efficiently in accordance with the legal procedures.In recent years,theoretical research on fugitive apprehension is becoming more and more popular in academic circle and there a number of forward-looking theoretical results have been made.However,these studies are mainly discussed from the aspects of legal regulation,legal dilemma etc.,even though there are some studies which discussed the problem from the aspect of investigation,most of them are about application of a kind of apprehending method or tactic.A systematical and comprehensive study of the problem of fugitive apprehension is still scarce.Therefore,research on fugitive apprehension is facing the dual demand of theory and practice.In view of the above reasons,this paper tries to seek the balance between theory and practice of fugitive apprehension on the basis of the existing research,and is practical problems solving oriented.From the perspective of criminal investigation,problems including current situation of fugitive apprehension,overseas experiences,difficulties analysis,methods classification,and mechanism optimization and innovation etc.are discussed in this paper,hoping to make some contribution to the construction of criminal investigation theory and fugitive apprehension practice.This paper is divided into six parts.The first chapter mainly summarizes the current situation of fugitive apprehension in China,including the definition of fugitive apprehension,review of the development process of this work,related laws and regulations,basic classification and function of fugitive apprehension.The second chapter is an important part of this paper trying to innovate.Since fugitive apprehension is much more operational and practical,by using the literature research method,the author studied a large number of foreign language-written literature of the US and the UK concerning the fugitive apprehension subject.,and chooses the fugitive apprehension mechanism of the US,the UK and Interpol which are much more mature as the research focus.By interpreting and sublimating specific methods of fugitive apprehension intelligence gathering,mechanism operation and campaign deployment etc.,the author drawn on the useful experience in multilabel classification of the US fugitive apprehension mode,government by network of the UK fugitive apprehension mode and information sharing of the Interpol fugitive apprehension mode,hoping to offer some reference and guidance for improvement of fugitive apprehension mechanism in our own country.In chapter three the empirical research methodology was adopted.By making quantitative and qualitative analysis of 100 typical fugitive apprehension cases,the author further clarified the present situation of fugitive apprehension in China,and the psychological characteristics of the escaped suspects,regular patterns of their activities etc.In the following chapter,the most difficult problem in fugitive apprehension practice,namely,fugitive apprehension of backlog case,was comprehensively analyzed in both subjective and objective aspects.Due to the objective reasons such as special geographical environment,overflow of anti-investigation information,increasingly lack of public trust toward the police,and the subjective reasons such as unclear responsibility of fugitive apprehension,lack of full-time investigators who are in charge of fugitive apprehension,and flawing fugitive apprehension mechanism,fugitive apprehension of backlog case stuck in embarrassing situation.The fifth chapter takes categorization as the paradigm,and classified the most common used methods and measures in the current fugitive apprehension practice.Differentiating the main driving force in each fugitive apprehension measure,the author divided the basic measures of fugitive apprehension into four types,namely,emotion-driven measure,information-driven measure,technology-driven measure,and explained the basic meaning and specific method of each type of measure in detail.Based on the above description and analysis of the subject concerning fugitive apprehension,the author put forward some constructive comments and suggestions concerning the optimization and reconstruction the current fugitive apprehension work in China from the macro point of view,hoping to offer some useful reference for the current fugitive apprehension practice.
