| In recent years,China railway vigorously promotes high speed railway(HSR)technology innovation and has established a complete HSR technology system.The HSR technologies have been developing fast and at the same time,great effort is dedicated to the protection of HSR intellectual property(IP).However,the HSR IP management system is currently not robust enough and the awareness of IP protection is to be enhanced,causing that the HSR innovation achievements are not fully protected hence confronts various IP risks at home and abroad.In the meanwhile,there is few research on HSR IP risk management by Chinese and foreign scholars,which makes this study of greater significance.This thesis is to focus on life-cycle HSR IP risk management mode to provide reference for Chinese enterprises while identifying HSR IP risks in advance and protecting the Chinese HSR technologies.The thesis first proposes a visual life-cycle Chinese HSR IP risk control management system framework,which is composed of an organization structure,two management subjects and three risk control models.The organization structure is for the HSR IP risk control management,the two management objects refer to the life cycle of technologies & products(R&D,achievement protection and market application)and the life cycle of risk management(risk identification,risk evaluation and risk response).The three risk control models refer to the risk control models respectively during the three stages of R&D,achievements protection and market application.Life cycle risk management for HSR IP is comprehensively carried out from these dimensions.Secondly,by analyzing the IP risk identification methods,major IP risks are identified during different stages like the R&D,protection of technology achievements and market application with actual examples provided.Based on the BSC theory,the HSR IP risk evaluation indexes are proposed from four perspectives of patent,technology,market and law,with an index system covering two grades and four perspectives established quantitatively and qualitatively.AHP principle is used for the experts to score the weighing of different HSR IP risk evaluation indexes.Both the quantitative and qualitative indexes are treated non-dimensionally to establish a HSR IP risk evaluation model.Three scenarios are defined,namely low risk,moderate risk and high risk to describe and evaluate the HSR IP risk status.Targeting response strategic matrix is proposed to respond to HSR IP risks confronted during the full life cycle of HSR technologies at different stages.Finally,a case study is carried out to comprehensively analyze the Chinese HSR IP risk management practice in country A on a life-cycle basis.According to the HSR IP risk evaluation model,comprehensive IP risk value for Chinese HSR technologies in country A is calculated to be 5.35,which indicates that the IP risk is considered to be at a middle level,and targeting response strategy is proposed.The expert verification also demonstrates that the research conclusion agrees with the actual conditions in country A and the IP risk evaluation model is reliable.To protect the Chinese HSR independent IP rights,IP risk management shall be carried out through the entire life cycle of HSR technologies and products.This thesis proposes the strategy for HSR IP risk management: to further improve the life cycle IP management,optimize IP exploration and layout and protect innovation achievements,attach importance to IP information analysis and improve the capacity for risk prevention,enhance coordinated IP protection to reduce the risks overseas,make more effort in IP talent training and enhance the awareness of IP protection.The thesis has unique innovations in:(1)establishing the life-cycle HSR IP risk control system model;(2)establishing a comprehensive HSR IP risk evaluation index system quantitatively and qualitatively covering two grades and four perspectives;(3)developing a strategic matrix for HSR IP risk response. |
