Under the circumstance of Rule by Law,based on sever situation for forest fire prevention,this thesis focused on the research of forest fire administration,explored and tried to perfect methods of forest fire administration in China by choosing American as the target of comparative analysis in order to improve the normative construction of forest fire manage in China.Forest fire administration means the administered behaviors that forest fire organizations use to decrease the numbers of forest fire by disseminating and increasing citizen’s awareness of forest fire prevention under the rule of related law.Forest fire administration is the governmental behavior of rule fire by law.The core body is the administrative organizations with the ability of forest fire management.Law,policy and education are basic methods utilizing to reach the final goal of decreasing forest fire.Even though the system and law diverge between America and China,the overall organization in a decentralized system is integrated in America.It is worth learning the concept of a sustainable and multipurpose ecosystem management revealed in American legislative spirit.China can also learn from American legalized,humanized and scientific management of fire source.The diversified dissemination provides an exemplary direction for China follow as well.A deep comparative analysis on these content is of great significance to consummate the forest fire management in China.By comparing and analyzing the forest fire administration in China and America,the thesis has reached following conclusions:Consummate liability regime of forest fire administration:(1)A system for CPC committees and governments should be established.Both CPC committees’ leaders and government leaders need to be responsible for forest fire.(2)A system of lifelong accountability will be put into effect for leaders of PC committees and governments,who are responsible for major forest fire.(3)Create a system that not only different levers of the government bodies take the responsibility for forest fires,but also the state government leaders,in this case,the state forestry bureau,will take the responsibilities according to their job description.The law system of rule fire by law should be consummated:(1)Forestry Law should be modified as soon as possible.It needs to certify accountability system of forest prevention leader.The law should also improve the status of safeguard for forest fire prevention.The compensation for area and citizen that suffer from forest fire should be added into the law.Forest Fire Prevention Article should be modified and consummated.The scope of Forest Fire Prevention Article needs to be expanded.It needs to establish an emergency system;an emergency action compensation system,and an ICS command system.The article should organize a interagency joint forest fire prevention agreement and consummate the system of catastrophic insurance for forest fire.(3)Prescribed Burning Management should be formulated.Establish approval system of prescribed burning by law.Further consummate the compensation system for forest ecosystem.(4)Improve the local legislation of forest fire management.Forestry Law should cover the whole country.Fasten the speed to enact local Prescribed Burning Method.Urge the local government to formulate Management of Fire Sources in Forestry area.Innovate fire sources administration:(1)Push forward the legislation of fire sources management:The local legislation should inform the Nation State or NPC for the record.Administrative behaviors without authorizing are considered as invalid.Urge the local to formulate the Management of Fire Sources in Forestry Area.(2)Establish the management of private forest fire sources.Innovate mechanism of fire sources management and control.Innovate accountability mechanism of fire.Innovate accountability mechanism of fire prevention.Innovate accountability mechanism of fire suppression.(3)Implement humanized management of fire sources.Civilization should replace tradition.Implement the method of"inform by fire" and economic compensation.(4)Reinforce informational management of fire sources.Cooperate with universities,enhance academic research,enlarge funding,and strengthen cross subject research.Improve the outcome of dissemination of forest fire management.The main method is to humanize the content of dissemination.Innovate diverse forms of dissemination and modern the methods of dissemination though technology.China needs to maximize the chance to realize the goal of forest fire administration by all-dimensional,multi-layered improving citizen’s awareness of forest fire prevention and law.
