The Study On The Maintenance Of Maritime Rights And Interests And Ocean Law Enforcement System Of South China Sea Countries

This paper mainly focuses on studying the maintenance of maritime rights and interests and law enforcement system of South China Sea countries,which is useful for understanding general dynamics and basic features of marine equity maintenance of ASEAN countries so as to provide reference for jointly building "the belt and road"to reach common benefit,building the maritime community of common destiny,peacefully solving the South China Sea dispute,and effectively maintain national maritime rights and interests.This article was guided by the maritime rights and interests and related theories to particularly analyzed the South China Sea countries(especially Vietnam,the Philippines,Malaysia,Indonesia),it summarizes the general law and characteristics of law enforcement of maritime rights and interests protection and ocean law enforcement system in various countries by analyzing major actions and measures for the maintenance of marine rights and interests as well as marine law enforcement forces and institutions in each country.The specific content includes four aspects:First,the theoretical connotation and definition of maritime rights and interests and related concepts,it mainly analyzes the definition,relation,and differences between connotation,sea power,ocean strategy.It points out that the maritime rights and interests is a general term for the rights and interests enjoyed under international law within the jurisdiction of the state or other countries,therefore,maritime rights and interests is a powerful foundation for safeguarding the rights and interests of the ocean,and marine strategy is a strategy for safeguarding maritime rights and interests,the building of sea power and marine strategy is aimed at maintaining and realizing the maritime rights and interests,The maintenance of marine rights and interests depends on the successful implementation of marine strategies.Second,it specifically analyzes the maintenance of maritime rights and interests in the countries surrounding the South China Sea,Focuses on the analysis of maritime rights and interests in neighboring countries in the South China Sea(especially Vietnam,the Philippines,Malaysia,and Indonesia,etc.),as well as objective,purpose,strategies and major actions for maintaining maritime rights and interests in order to discover common grounds and differences in the maintenance of maritime rights and interests in countries surrounding the South China Sea so as to understand their basic features and general law,which could provide the references to China’s maritime rights and interests maintenance,Meantime,develop specific measures for specific countries and implement "One Country One Policy".Third,it gives detailed analysis of the marine law enforcement system in the countries surrounding the South China Sea,Focuses on the formulation and promulgation of marine laws and regulations in the countries around the South China Sea,the relationship and coordination between the law enforcement and the law enforcement agencies in the ocean,and so on,At the same time,analyzes their advantages and disadvantages and summarizes their various characteristics.Fourth it conducts comparative analysis on the maintenance of maritime rights and interests and maritime law enforcement system in the countries surrounding the South China Sea,although the country’s national conditions are different and their maritime rights and interests are maintained in different ways,they do have some common points and regularities,Including each country’s marine strategic objectives have their own focuses,their purpose coincides,and their methods and strategies are roughly similar.All countries attach great importance to maritime law enforcement and maximize the protection of maritime rights and interests.However,laws and regulations in various countries still need to be improved,the law enforcement coordination capability needs to be enhanced,and ability of law enforcement needs to be upgraded.
