At present,there exists complex disputes over island sovereignty,legal status of island and maritime delimitation in South China Sea,and the traditional and non-traditional security issues in the above disputed maritime areas have arisen one after another.Countries have been chaotically engaged in law enforcement in disputed maritime areas,and China’s maritime rights and interests and ocean strategy are facing risks and challenges.Law enforcement in the disputed maritime areas may not only affect the significant interests of China,but also affect the interest of all other countries concerned.Various internal and external factors brought about much more difficulties in law enforcement in the disputed maritime areas.However,at the same time,the challenges brought by the above complicated situation also provide possibilities and opportunities for relevant countries to seek law enforcement cooperation in disputed maritime areas.China and other countries concerned also have shared concern and interests in both economic,political and security respects.China should gradually push forward law enforcement coordination and cooperation on low-level and low-sensitivity security issue,and then strive to reach consensus and deepen bilateral understanding and mutual trust and may also help resolve the disputes through amicable negotiation.This dissertation firstly presents the current situation of law enforcement in disputed maritime areas of South China Sea,including the definition of several concepts,status quo of disputed sea areas and the status quo of China’s law enforcement legal basis,authority and actions,and the main law enforcement needs of China in disputed maritime areas.Secondly,it analyzes the main problems of law enforcement in disputed maritime areas from both domestic and international perspectives,which includes the non-uniform and uncertain standards for the application and interpretation of laws in disputed maritime areas,the variety of the law enforcement authorities designated by different countries,and there being no clear limits on the use of force in maritime law enforcement in the disputed maritime areas.Then,it proposed the suggestions for China to strengthen the enforcement of disputed maritime areas in the South China Sea after the presentation of the above-mentioned contents,among which the most important measure for China is to promote law enforcement cooperation in disputed waters,including signing bilateral and multilateral agreements to determine uniform criterion on law enforcement authority,the use of force,and the law enforcement matters;establishing disputed maritime area law enforcement cooperation mechanisms,which comprises both permanent mechanism and dispute settlement mechanism;and strengthening inter-state information sharing and the joint training of law enforcement personnel.From the above-mentioned multiple perspectives,it is feasible to promote law enforcement cooperation in the disputed maritime areas of the South China Sea,bridge differences,enhance mutual trust,and build a new regime for law enforcement in regional disputed maritime areas of the South China Sea.
