Legal Issues In The Law Enforcement Of The Rights In The South China Sea-under The Background Of Constructing 21st Century Maritime Silk Road

With the development of machinery industry since modern civilization,people's activities footprint extends to the ocean.Ocean,as a huge potential treasury,attracts more and more attention.However,the allocation of resources is often accompanied with disputes.In recent years,the South China Sea has been repeatedly violated by Southeast Asian countries for its important strategic position and enormous economic benefits.Vietnam,the Philippines,Malaysia,Brunei and other countries ignores our sovereignty,invades the South China Sea islands flagrantly.Since 2013,the general secretary Xi Jinping,put forward a major strategic vision to build and expand the 21 st Century Maritime Silk Road,and the creation of cooperation,peace and harmony in the South China Sea environment has a very important meaning for the construction of our country to further promote the Maritime Silk Road.Thus,in the background of building the 21 st Century Maritime Silk Road which refer to a peaceful development,the way to maintain the interests of South China Sea has become one of our common concern and cause widespread research.Under the background of the construction of the 21 st Century Maritime Silk Road,this paper tries to discuss how to strengthen the way of law enforcement in the South China Sea.Based on the current situation in the South China Sea and China's status in the South China Sea rights law enforcement are analyzed,pointed out the existence of China's current marine consciousness is weak,imperfect legislation,lack of law enforcement forces and participation is not high on the international judicial system.To solve these problems,we should increase to provide international public goods for the South China Sea area,to further improve the marine legal system,and improve the level of law enforcement to strengthen the rights of the South China Sea,the South China Sea rights law enforcement,improve the regional mechanism of peaceful settlement of the South China Sea dispute,to form and adapt to international ocean rights management of the South China Sea rights system,maintain our country in the South China Sea the territorial sovereignty and maritime rights and interests.At the same time,we also have to do the best docking in the construction of the Maritime Silk Road and the South China Sea rights enforcement,by promoting resolve tensions between Chinese and Southeast Asia and other countries on the South China Sea dispute caused by this strategy,and with the economic development and the actual control to declare the South China Sea sovereignty,strengthen our country in the South China Sea issue the right of discourse and global control.
