Abstract/Summary:
The dissertation study focuses upon constructing a conceptual structure descriptive of the criminogenic social processes in the transnational business sector.;Methodological tools adopted by nationstates in developing foreign policy instruments are utilized in identifying transnational processes. Review of social science literature, as well as logical conceptualization at an abstract level are heavily relied upon in developing theoretical propositions upon which the conceptual structure is built. The causal relations of transnational processes underlying the conceptual structure and are related to transnational corporate deviance are examined, and the theoretical propositions which express such relations are supplemented with, empirical observations made on a carefully chosen set of sample cases. Cases representative of different types of issues, countries, corporations and regions were picked from academic research studies and documents of international organizations.;The conceptual structure focuses upon the dynamics of transnational processes which are defined as a function of the vertical and horizontal interactions within and among nationstates and corporations. Transnational corporate deviance is defined as a product of the function of such transnational processes, and deviance as a concept relatively assigned to particular transnational conflict situations rather than universally.;It is argued that transnational processes created by transnational corporate operations weaken the legitimacy of the state upon which national control depend, and that, therefore, individual national control will be ineffective in minimizing transnational corporate deviance. Hence, the ultimate objective of this exercise is to construct a conceptual structure which can be utilized as a tool for analyzing transnational criminogenic processes, as well as for developing management structures which depend for their source of authority on integrated transnational systems.;The study is based on the notion that since there is no uniformity of norms in the transnational sector, the function of law is to regulate the interactions of governmental, corporate and other societal units with a view to enhancing their solidarity rather than to repress functional activity of such units by control mechanisms. Having labelled the regulation approach as management, the study adopts a management perspective.
