A Research On The Legal Issues Of The Reforming Governance Of FIFA

Football is one of the most widely accepted,most popular and most affected sport all over the world.FIFA(Fédération internationale de football association,“FIFA” for short)as the specialized management authority of the football world,after 110 years of development,has evolved into the second largest International Sports Federations(International Sports Federations,“IFs” for short),except for the International Olympic committee(“IOC” for short).FIFA manage its internal organization activities according to its internal regulation,just like the FIFA Statutes.In details,the first part of the research is an introduction the overview of FIFA.On the one hand,the concept related to FIFA is clarified,and defines FIFA as an International Non-Governmental Sports Organizations from the perspective of international organization law,and then defines its legal status clearly.In turn,the mission and purpose,membership and organizational structure of FIFA have been introduced.On the other hand,explains the theoretical basis of FIFA exercise power to its members and non-members of international football,subdivides the power of FIFA into five categories: power to set the international football autonomous rules,power of the member certification approval,daily management and organization of power,power of disciplinary punishment and the disputes settlement.The second part provides theoretical support for the Reforming Governance of FIFA by the governance theory,good governance theory and sports governance theory,and analyzes the relationship between three kinds of theories and sports autonomy.The third part is a review and comments of FIFA’s governance reforms.Firstly,analyzes the FIFA Governance and Reform of 2011-2013 and 2016 from the perspective of reform background,reform content and reform evaluation.Then,compared the FIFA Governance Reform with the IOC reform from three aspects: the reform background,contents and reform effect,analyzes the similarities and differences between Reforming Governance of FIFA and IOC Reform.The fourth part of the research summarizes the legal issues of Reforming Governance of FIFA.There are two main aspects: On the one hand is the excessive autonomy of FIFA,on the other hand,is the corruption of FIFA.Analyzes The symptoms of the problem,and the cause,to set a foundation for the next part.The fifth part of the research is divided into two parts.On the one hand,summarizes the experiences of the FIFA governance reform.On the other hand,provides experiences to the reform of Chinese football association.The way to achieve an entail successful FIFA governance and reform is to promote both the internal reform and external pushes.The suggestions to Chinese football association were divided into two parts: to clarify the legal status of the Chinese football association,and solve the existing problems on the disciplinary punishment and dispute resolution mechanism.
