Research Of Energy Regulation Legal System

With the continuous reform of China's energy regulation system,energy regulation is developing towards marketization,institutionalization and low carbonization.How should the legal system of energy regulation respond to the reform direction of energy regulation is one of the most important issues in energy law research.Based on the analysis of the problems in the energy regulatory system,the energy market regulation and the energy environment regulation,this paper analyzes the causes of the energy regulatory legal problems,compares the forms of foreign energy regulatory legal systems,and discusses the concrete construction and improvement of China's energy regulatory legal system.In the introduction,it introduces the background of the discussion on the legal system of energy regulation,the transformation process of energy regulation concept,and the influence of energy regulation concept on the form of the legal system of energy regulation.And it summarizes the domestic and foreign research on energy regulatory legal system,and proposes the research approach and method of this paper.The first part raises the legal issues of energy regulation.Energy regulatory system,energy market regulatory issues,energy environmental regulatory issues as the coordinate.Sorting out the problems in the energy regulatory system,such as decentralization of functions,fuzzy jurisdiction,weak regulatory power and rigid demand.Market construction,market regulation and competition,order fairness and efficiency in energy market regulation;The complexity of energy waste,energy consumption,pollution and regulation in energy environment regulation.The second part analyzes the causes of the legal problems of energy regulation.Corresponding to the legal issues of energy regulation,the paper analyzes the energy regulation system,market regulation and energy environment regulation.Due to the complexity of the energy industry and the fragmented regulatory model of the energy industry for a long time,the disadvantages of monopoly in the energy industry and energy information barriers have been formed,which hinder the reform of the energy regulatory system.Due to the particularity of energy,the interest game carried by energy,the sociality of energy,and the limitation of energy regulation function,the reform of energy market regulation is faced with many challenges.Due to the complexity of causal relationship of energy environmental pollution,the passivity of ecological damage relief,and the imperfection of the legal system of energy ecological environment regulation,the innovation of energy environmental regulation is also affected.The third part compares the domestic and foreign energy regulatory legal system and analyzes the energy regulatory legal system in the United States,Britain,France,Germany and other countries in the fields of energy market reform,environmental energy regulation experience,and proposes the specific measures of China's energy regulation innovation.The fourth part puts forward the construction of China's energy regulatory legal system.To propose and analyze energy regulatory issues,design energy regulatory legal system in line with the reform of energy regulatory system,improve the legal system and organizational structure of energy regulatory,and rationally allocate and define the functions and powers of energy regulatory;We should design a legal system for energy regulation that is in line with the market-oriented reform of energy,improve the system for access to the energy market,formulate a competition and regulatory system for the energy market,and formulate a trading system for the energy market,so as to promote effective competition and sound operation of the energy market.To design a legal system for energy regulation that can deal with energy and environment problems,formulate a regulatory system for rational use of energy,formulate a legal system for energy and environment regulation,and formulate a legal liability system for energy and environment regulation,so as to effectively deal with and solve energy and environment problems.The conclusion is that China's energy regulation system is based on government services,with the enterprise innovation as key and supplemented by social autonomy according to law.This paper analyzes the formulation and improvement of the energy regulation legal system under the background of transformation of government functions.From the perspective of comprehensive energy market reform and energy ecological protection,the author hopes that many dimensions analysis will be introduced to the study of energy regulatory legal issues.
