| The international community emphasizes the conservation and management of marine fishery resources.Against such background,"Illegal,Unreported and Unregulated Fishing"(IUU Fishing)has become a major obstacle to global marine fisheries management.This paper focuses on the international legal system and specific regulatory measures of IUU Fishing,and finally puts forward personal recommendations in the light of the current situation of IUU Fishing control in China.In addition to the introduction,the main part of the paper is composed of the following six chapters:Chapter 1 mainly introduces the historical background of the concept origin of IUU Fishing and discusses the definition of three specific forms of IUU Fishing.At the same time,it describes the current situation of IUU Fishing and the hazards faced by IUU Fishing worldwide,and takes the Indian Ocean as an example for detailed analysis.Chapter 2 focuses on the economic,social and international legal system causes of IUU Fishing,and the theoretical research on the theory of sustainable development,"tragedy of the commons",ecological protection and fishery resource management in regulating IUU Fishing.Chapter 3 examines the international legal system that has been built up to regulate IUU Fishing from two levels:international hard law and international soft law,and analyzes the pros and cons of these two levels.In the meantime,this chapter analyzes the important role played by regional fisheries management mechanisms,with regional fisheries management organization(RFMO)as the main regulatory body,in combating IUU Fishing,taking into account the current status of IUU Fishing control in the Indian Ocean.Based on the interpretation of the international legal documents related to IUU Fishing in the previous chapters,Chapter 4 summarizes the main regulatory measures adopted by the international community to deal with IUU Fishing,and takes time as the logical context to study the specific measures to control IUU Fishing from three different stages:before,during and after the entry of fishing vessels into the sea to catch fish.Chapter 5,as a problem-oriented part,studies the problems encountered in controlling IUU Fishing,such as the phenomenon of "Flag of Convenience",illegal transshipment at sea,the difficulties occurred in the implementation of IUU vessel list system.Moreover,the coordination between the trade restriction measures of IUU catch and the WTO principles of free trade are deeply analyzed one by one.Finally,the causes of the above-mentioned problems are analyzed and the possible solutions are suggested.Chapter 6 analyzes the existing measures and deficiencies in China’s domestic regulation of IUU Fishing.proposes domestic and international measures that China should take to participate in IUU Fishing control in the context of the "Belt and Road"initiative.Among these measures,the demonstration is focused on specific proposals such as promoting China-India joint maritime fisheries law enforcement action,developing China’s national plan of action against IUU Fishing,and,last but not least,preparing for joining the Port State Measures Agreement as soon as possible. |
