| The rule of law is the cultural achievement created by human beings,the common value pursuit of all ethnic groups,and the basic way of running a modern country.The thinking mode of rule by law is based on the core of rule by law.The success of the rule of law and the realization of the ideal of the rule of law in China depend directly on whether all the citizens have formed the thinking of the rule of law.The cultivation of contemporary college students’ thinking on rule of law is not only an important part of the cultivation system of citizens’ thinking on rule of law,but also an important part of modern higher education.It is of great theoretical significance and practical value to carry out the research on the cultivation of contemporary college students’ thinking of rule by law.This paper insists on the theory of Marxism and its localization in China,deals with the cultivation of contemporary college students’ thinking under the rule of law from the perspective of ideological and political education,by using the research methods of theory and practice,history and logic,emphasis and general,and following the basic logic of "Explain the connotation and characteristics—Enrich the theoretical foundation—Identify real world issues—Build a strategic framework”,to systematically build a theoretical framework for the cultivation of contemporary college students’ thinking of rule by law.First of all,on the basis of in-depth explanation of the research background and value of the cultivation of contemporary university students’ thinking on rule of law,the current research situation at home and abroad,as well as the research emphasis,difficulties and innovations,from the perspective of ontology,this paper makes a deep interpretation of the connotation and characteristics of thinking of rule by law,thinking of rule of law of university students,the cultivation of the of thinking university students,and related concepts of the thought of rule of law.It is pointed out that college students are the main body of the thought of rule by law,the thought of rule by law must be cultivated after birth,and the key to the thought of rule by law is to transform the way of thinking.The characteristics of the cultivation of university students’ thinking on rule of law are summarized as the characteristics of the Times,integration,humanity,systematicness and long-term,etc.It also points out that the cultivation of the contemporary college students’ thinking of rule of law is of great practical significance for the correct understanding of the concept of rule of law,the shaping of the core values of rule of law,the exercise of rights and obligations in accordance with law,and the rational evaluation of social behavior events.Secondly,exploring the theoretical basis for the cultivation of university students’ thinking of rule by law,that is,the Marxist concept of the rule of law,the Marxist theory of the all-round development of human beings,the party and the country’s comprehensive strategy of governing the country by law,and Xi Jinping’s thoughts on the rule of law and its education.It systematically combs the Chinese traditional thought of rule of law and education of rule of law,the Western thought of rule of law and education of rule of law,This paper analyzes and summarizes the main experiences of the United States,France,Singapore and other countries in the cultivation of college students’ thinking on rule of law,that is,the infiltration of the cultivation mode of the rule of law thinking,the cultivation content of the quality-oriented education of citizens,and the diversity of the cultivation mode of the rule of law thinking,and uses them as reference for promoting the cultivation of college students’ thinking on rule of law in China.Thirdly,based on the results of empirical research,and on the basis of fully affirming the achievements made in the cultivation of university students’ legal thinking,this paper reveals the main problems existing in the cultivation of university students’ thinking under the rule of Law: the gap between the students’ thinking under the rule of law and the requirements of the rule of law,the imperfect top design of the cultivation of the thinking under the rule of law,the insufficiency of the professional accomplishment of the teachers of the cultivation of the thinking under the rule of law,the single way and mean of the cultivation of the thinking under the rule of law,the lack of external environment and the weakness of the resultant force.And from the negative factors that affect the construction of the rule of law,the traditional emphasis on moral education rather than the chronic disease of the rule of law education,the mismatch between the supply side and the demand side of the cultivation,the unreasonable ways and methods of the family rule of law education,and the weak self-management and restraint ability of the students,etc,this paper probes into the causes of the problems existing in the cultivation of university students’ thinking under the rule of law.Finally,this paper focuses on how to cultivate the contemporary college students’ thinking of rule of law,and constructs the theoretical framework of cultivation from the aspects of cultivation goal,cultivation content,cultivation process,cultivation mechanism,cultivation method,cultivation path,etc.According to the realistic problems and predicaments,the expectation of the State and society,the law and demand of the growth of the university students,this paper constructs the progressive objective system of the cultivation of the thought of rule of law of the Contemporary University students,that is to form the rational cognition of the rule of law thinking,deepen the recognition of the value of the rule of law thinking,improve the quality of the thinking ability of the rule of law,form the thinking habit of doing things according to law,and consciously respect and maintain the authority of the rule of law.The content of the cultivation of contemporary college students’ thinking on rule of law is hierarchical,of which the most core is the content of the thinking level,that is,to cultivate the thinking on the supremacy of law,the thinking on rights and obligations,the thinking on due process,the thinking on power restriction,the thinking on fairness and justice,the inner relationship of the above-mentioned cultivation contents was explored.This paper expounds the inner logic of the formation of the rule of law thinking of the contemporary university students from the requirements of the rule of law,the legal knowledge,the legal method,the belief in the rule of law,and the way of the rule of law,and probes into the process mechanism of the cultivation of the rule of law thinking of the Contemporary University students,that is to say,the mechanism of multiple cultivating subjects with the same structure,the mechanism of the superposition of the two processes of education and cultivation,the mechanism of the mutual integration of cognition and practice,and the inherent organic unity mechanism of truth,goodness and beauty,the basic links of the cultivation of the contemporary university students’ legal thinking are explained from four aspects: the formulation of the cultivation scheme,the implementation of the cultivation measures,the evaluation of the actual effect and the feedback of the cultivation results.It also proposes to construct the psychological identification mechanism,the ideal-oriented mechanism,the interest-driven mechanism,the supervision and evaluation mechanism,and the comprehensive guarantee mechanism,so as to promote the systematization and long-term effect of the cultivation of the university students ’legal thinking.It puts forward the principles of cultivating the contemporary college students’ thinking of rule by law,that is,the unity of theoretical education and practical education,the unity of explicit education and implicit education,the unity of legal education and moral education,the unity of classroom education and daily management;This paper probes into the methods of cultivating the contemporary college students’ thinking of rule by law,that is,the course teaching enhances the thinking ability of the rule of law,the practice training enhances the thinking depth of the rule of law,the model demonstration leads the thinking direction of the rule of law,the credit file promotes the thinking consciousness of the rule of law,the group education strengthens the thinking experience of the rule of law;This paper expounds the carrier of the cultivation of contemporary university students ’legal thinking,namely,the carrier of Culture,the carrier of activity,the carrier of Network,the carrier of management and the carrier of interpersonal relationship;This paper points out that the path of the cultivation of university students’ thinking on rule of law should be carried out from four aspects: Strengthening the publicity and education on rule of law,perfecting the education and teaching system,creating the cultural environment of rule of law,and promoting the comprehensive administration of schools according to law. |
