The Studying On The Obstacles And Countermeasures Of Environmental Administration Enforcement In China

Environmental issue is the relationship between human being and environment. Under the guidance of traditional concept of development, human dealt with it wrongly. After 20 years of rapid development, China's environmental legal system has initially formed. But generally speaking, the environmental laws that have been made are not full and effective implemented. This is now a prominent and urgent problem in our country. Sustainable development concept emphasizes ethical and ecological values, unified by immediate interests with long-term interests. This is the only correct choice of environmental protection. We should establish the principle of "ecological interests first" in environmental legislation, promote fundamental reform of the environmental legal system, enhance the efficiency of law enforcement, promote the institutionalization of the national environmental education and establish a mechanism for public participation in China's environmental protection. It is a reliable guarantee to promote sustainable economic development and environmental protectionStrengthening the implementation and building enforcement capacity of environmental law is the main issue to building of the legal system; researching and referencing foreign environmental law can play a positive role in promoting China's legal construction. Western developed countries, mostly in the 1960s, after a serious environmental issues, strengthened their environmental law enforcement, and formed a law enforcement model with their own characteristics.The obstacles of environmental administration enforcement mainly come from the regional protectionism caused by the incorrect views of political achievements and development of local government, the insufficient authority power of enforcement agency, the minor punishment to illegal activities, as well as public views of environmental protection. This thesis is based on the analysis to the behaviors and causes of hinders of environmental administration enforcing, and then puts forward the countermeasures, desiring to explore the basis for the modification and enforcement of the Environmental Protection Law.Through analyzing the current situation of the environmental government execution, this thesis tries to get the problems existing in the environmental execution, uses for the references of the successful experience of the external environmental government execution on the basis of analyzing the reasons, consequently puts forward the relevant legal policy that can resolve the problems existing in the environmental government execution. With the comprehensive analysis of the current problems existing in the environmental government execution of our country and the advisement of the successful experience of the external environmental government execution, the internal environmental government execution should be improved from the legislation, system, supervision, means, consciousness and so forth ,construct the correspondingly better system of the environmental government execution, promote the public awareness and the relevant department, so this can have some definite action on constructing a series of the environmental government execution systems that adapt to the current society's development.
