On The Environmental Dispute Settlement Mechanism

Long time, with efforts from academe, the theory of mechanism for solving environment dispute became mature basically. The mechanism is based on environment right, and supported by basic laws for negotiation, intercession, arbitration, litigation. Through specified procedure and mode, to realize environment justice, solve the environment dispute and conflict, resume social balance and order. In fact, the characteristic mechanisms for solving environment dispute have already built in developed countries. Environment commonweal lawsuit in USA is obvious, administration disposal is characteristic in Japan. Compare to inner requirements of basic theory for solving environment dispute and to mode in developed countries, many problems exist in China such us shortage of special laws for environment dispute disposal, difficulty for running environment suits, nonstandard administration disposal. Therefore, it is required confirming the environment rights and environment commonweal lawsuit regulations, improving ADR regulation and etc, in order to distribute again rights and obligations radically, to enact again legal proceedings, to build multified mechanisms for solving environment disputes.
