Legal Research On The Equality Of Basic Ecological Environment Service

Since we implemented reform and openness 30 years ago,our country have been taking economic construction as center, and our economic growed rapidly. But we also neglected comprehensiveness of our society's development in the development process, compared to the developing speed of our economy, social management and public service of our country fall far behind. So, Party and country set goal to build a service-oriented government in this new development process. To build a service-oriented government, we must adjust the government's functions, lay more emphases on public service, establish a sound and fair public service system which can develop sustainable and benefit all people, and promote the equality of basic public services.Equality of basic ecological environment service is the most fundamental and important content in equality of basic public services. As is well known, survival right is a fundamental right of human being. Human survive first, then they can develop. And human can't survive without the fundamental environmental elements,such as air, water, human can't survive without a secure and healthy environment. Due to the intrinsic attribute of ecological environment, intervention of government is necessary. Government is the primary provider of basic ecological environment service. Now, apparent imbalance exists in our country's basic ecological environment service. Inhabitants of city and eastern zone enjoy much more basic ecological environmental services than inhabitants of countryside and western zone do.Virtually, unequality of basic ecological environment service is injustice of environment, which primarily reflected in form and substance. On one hand,national legislation do not ensure every civil's environmental right fairly. Due to the lack of secure and healthy ecological environment, fundamental environmental benfit of civil can not be ensured, and civil's survival is threatened. On the other hand, imbalance of economic development leads to a serious deficiency of basic ecological environment service's supply. To realize the equality of basic ecological environment service, we need not only to consummate the existing legislative system of our country to make every civil's environmental right be ensured, but also to enhance the existing public finance system of our country, increase transfer payments to ensure the ability of government at all levels to provide basic ecological environment service.
