Studying Environmental Public Participation On The Basis Of Environmental Administrative Guidance

In the current China,with the deepening of the environmental movement, public participation in environmental protection have shown unprecedented enthusiasm. A wide range of public participation in environmental protection activities are also in the ascendant. But we should also see that passion may not be rational, even passion and reason that is difficult compatible. The value of public participation is not just simply rely on public participation in itself can achieve. Currently, chinese society is not a lack of public participation, but the lack of a more orderly and effective public participation. At the same time, with the continuous deepening of reform and opening up, our society has been formed with different interests and needs of social groups and stratums, showing the diversity of interests and value. Interests and the value of diversity raised new issues and challenges on the mode of governance. In the past, the executive power itself means enforcement, and indeed often the executive power and enforcement closely together. But now, the chief of the mandatory colors has been diminishing with the transformation of chinese society. More and more use of government contracts, guidance, service and other flexible means to achieve administrative goals. Administrative guidance, administrative contracts, administrative information services and other non-mandatory administrative acts which are playing an increasingly important role.In this paper, I have in-depth analysis of environmental public participation theory. Then, I seriously thought about chinese environmental public participation activities. On this basis, I pointed out the weaknesses and inadequacies of public participation in environmental protection activities. Then, I demonstrated the use of administrative guidance to standardize environmental public participation in environmental activities, the necessity and feasibility. And use examples to demonstrate how the executive branch guidance to the public participation in environmental protection activities. The Part V of the paper perfects mechanism of environmental administrative guidance to achieve the goal of environmental public participation.
