Study On Ligal Problems And Countermeasures Of Heilongjiang Sanjiang Nature Reserve

Sanjiang nature reserve is located in northeastern Heilongjiang province,within the boundaries of Fuyuan and Tongjiang, is inland wetlands and waters ecosystem types nature reserve, the main protection object is by aquatic and terrestrial organisms and their habitat together form marshes. Sanjiang nature reserves has retained the most complete freshwater marshes ecological system in northeast China, reserve establishment has great strategic significance to maintain the regional biodiversity, improve ability of regulates the flood and disaster prevention, promote economy and resources and environment coordinated development, ensures the ecological security, realizing the sustainable development of sanjiang wetland. But,sanjiang nature reserve are also facing many problems which restricts the sustainable development, such as wetland protection laws system is not perfect, the management system is not sound,the community residents protect consciousness to be weak,etc.These problems makes the phenomenon such as illegal reclaim wetland and excessive use of resources becomes more and more serious, cause wetland area is increasingly decrease, Wetland landscape largely disappearing, biodiversity serious damaged, worsening ecological environment.The wetland original function of degradation pollution and adjusting the climate and regulates the flood weakens gradually, causing flooding disasters and wetland worsening environmental pollution. Work of wetland protection in the reserve is facing serious challenges, a series of legal problems needed to resolve.This paper adopts the methods of analysis and comparison and inductive method, through research the existing legal problems in sanjiang nature reserve, based on reference to the study of foreign advanced experience and development trend, put forward the idea of these legal problems perfect. Full text is divided into five parts:the first part is the introduction, introduces current research of wetland conservation law issues,expounds the purpose and meaning of this study;the second partintroduces the natural conditions,protect object and significance, ecological characteristics, historical evolution of sanjiang nature reserve;the third part analyzes existing legal problems in sanjiang nature reserve, such as current law inadequate safeguard,poor lawfully oversight, ecological compensation system is not sound, etc; the fourth part introduces America, Australia and Japan's advanced experience in wetland protection, and get some enlightenment and reference;the fifth part is the core and key of the paper, puts forward suggestions of consummates the existing legal problems in sanjiang nature reserve, including the idea of formulate local laws and regulations of Heilongjiang sanjiang nature reserve,and clear the purpose,principles,institutional framework and iegal responsibility of legislation. construct entire reserve overseeing mechanism, environmental impact assessment system and ecological compensation system, establish the reserve development license system and community comanagement system, the rule of law and a series of system establishment perfect, can play a crucial role for sanjiang nature reserve better work in wetland protection.
