The Research On The Perfection Of Legislation Of China's WEEE Recycle And Disposal

Waste electrical and electronic equipments (WEEE), as an arisen problem, has close relationship with the country's economic development level. Unlike the other solid waste, WEEE includes a lot of resources and poisons, if we can reuse and dispose them reasonally, it not only protects environment but also saves resources. The meaning of recycle and disposal of WEEE in legislation is assigning the responsibilites consisted in process of WEEE's reusing and disposing to the EEE producers, distributors, consumers, recyclers and government etc, in this way, we have certain subject to take legal obligation. Our country had made some law and regulations in this area, there still existed some deficiencies e.g. it lacks special law for WEEE's reusing and disposing, low-level legislation, poor operation, unclear responsible subject and unclear management object etc.Perfection of legislation of China's WEEE recycle and disposal should guided by theory of sustainable development and circular economy. Taking legislation experiences of EU, the USA and Japan for references, we should start from our present situation. For example, during the process of WEEE's reusing and disposing, we should take Extended producer Responsibility etc. The key point of the perfection of WEEE's legislation is implementing EEE producers, distributors, consumers, recyclers and government's specific responsibility, make relative subjects play their own functions and cooperate with each other. In order to reach this goal, we need to establish and perfect a series of legal systems including WEEE's recycling system, recycling permit system, administrative supervision system, government support system and information management system. We need specific system to maintain the electronic waste recycling work operate smoothly.
