Lakes are natural complexes which consist of lake basin, lake-water, and the substances (minerals, soluble materials, organic matters, and aquatic life, etc.) and participate in natural cycle of matter and energy with water storage, water supply, culture, shipping, tourism and the preservation of biodiversity and many other functions. Lakes are not only clear natural areas, but also provide the eco-economic system for the management and administration of the national economy and the comprehensive development centered on the exploration, utilization and protection of water resources, playing an important role in the continual development of the entire economic society. Dong ping Lake is the convergence of the three major river systems -- Yellow River, Wen River, and Yun River. The Dong ping reservoir is the most often used flood diversion area at the lower reaches of the Yellow River and the natural detention area of Dawen River -- the largest tributary of Yellow River's lower reaches. At the same time, it is the storage reservoir of the South-to-North water diversion project and the source of the project of transferring water from west to east in Shandong Province. As the director Li Guoying of Yellow River Commission said, Dongping Lake is the most important chessman in the flood control at the lower reaches of the Yellow River and the strategic layout of the utilization of water resources and is one end of the "dumbbell" strategy of Yellow River in Shandong. The research on the management and operation of water property rights of Dongping Lake plays a crucial role in the economic development of water resources of Dongping Lake and regional socio-economic development and improvement of the ecological environment.This paper follows the tradition of research from the study of the real world of the new institutional economics, with the water right as the core theory, integrates the property rights theory, transaction cost theory, the rent-seeking theory, theory of government regulation and other relevant analytical methods and analytical tools, applies the theoretical Dongping River analysis model to the management and operation of water rights issues and then propose some relevant policy recommendations. The conclusions of this paper on the study of Dongping Lake property management and operation of water resources are carried out from the following aspects:(1) This section focuses on water property rights theory and analysis of property rights theory, and on the basis of which, the characteristics and trends of foreign ownership of water resources management are summarized, drawing enlightenment on China's Property Management of Water Resources. At the same time the study carries out an overall analysis of cost and efficiency of defining the water rights and finds out three ways for allocation of water rights: government-led, market-oriented and democratic consultation type; and two ways for the market-oriented operation of water rights: water rights exchanges and Bank of the water right.(2) On the basis of the comprehensive analysis about the economic and social development and geographic location of Doing Ping Lake, combined with the current situation of the irrigation water rights management of Dongping Lake, this paper focuses on analysis of the definition, initial allocation and market transactions of irrigation water rights of Dongping Lake, finding out three kinds of market transactions of the right of Dongping Lake irrigation water: farmers water user agreements, water rights exchanges and water rights banks. As for the problems in the irrigation water rights management and operation of Dongping Lake: large proportion of irrigation water, backward irrigation methods, low efficiency of water use; old-time water rights system, obscure irrigation water rights; irrigation reform frustrated by the large amount of bedload; unreasonable irrigation water price, this paper puts forward on the basis of comprehensive analysis the following suggestions: deliver the Dongping Lake water rights for irrigation to the specific water users; for its initial allocation, appeal to the stepwise allocation from the provincial water conservation department to city-owned water sector, and then to the township water conservancy department, finally to the farmer associations level distribution, and release "water license" or "water-tickets" for them to register officially; raise the irrigation water price properly on condition that the normal production can be guaranteed.(3) After analyzing the concept definition of culture water rights and significant cost-effective type, with the external nature, separability of ownership and use, and proactive features of transaction, etc., this paper lays emphasis on the defining and initial allocation of breeding water rights of Dongping Lake and market transactions, analyzes the defining cost and benefits of culture water as well as the three forms of market transactions. At the same time, for the problems emerged in the management and operation of aquaculture water rights of Dongping Lake, like, water fishery legislation is not sound; infrastructure is old-time; water level is not guaranteed for fishery; biological diversity can not be guaranteed; fishery management is not standardized; the loss of resources are serious, the following recommendations are made: optimize the aquaculture structures, implement the fisheries eco-engineering; determine the minimum water level of fish farming, ensure sustainable development of fisheries resources, use legal means to protect the water fisheries to achieve sustainable development.(4) On the bases of the introduction about the ecology and tourism landscape of the Dongping Lake, this paper analyzes the ecology, tourist attractions and characteristics of the concept of water rights of Dongping Lake, and makes the initial allocation and demarcation, proposing that the ecology and landscape water rights should be demarcated to the Dongping Lake Management Committee. What's more, this paper presents some problems in the water rights construction of Dongping Lake's ecology and tourist landscape: the water for ecological and landscape construction is seldom guaranteed; the ecosystem has been destructed; Dongping Lake has been seriously polluted; the ecology and landscape functions are threatened; the ecology and landscape water rights are obscure, management rights are criss-cross; Dongping water ecology, landscape water rights system are out of date. And problem-solve strategies and recommendations are: to develop a more authoritative Water Law as soon as possible; by adopting legislation, to state clear the legal status of Dongping Lake on ecological and landscape water rights; Governments at all levels should increase the ecological, landscape construction investment to ensure the sustainability of the ecological environment Dongping Lake; to develop a rational water pricing to promote the sustainable use of landscape water; to strengthen the unified management of the Yellow River Basin by strict examination and approval system and strict supervision and punishment .(5) This paper has made an in-depth analysis about the Dongping Lake pollution status and causes, and on the basis of which, the definition of pollution rights on the Dongping Lake, the initial distribution, and market transactions are discussed with emphasis. At the same time, this study puts forward the suggestions to improve the Dongping Lake eco-environmental quality, to ensure sustainable development and utilization of lake resources in a number of pollution prevention and control measures: Strengthening river basin ecological construction, speeding up the Dawenhe water pollution reclamation; speeding up the drainage reservoir construction and the progress of transformation and treatment of water logged land areas, recovering and establishing the semi-natural wetland purification ecosystem of Dongping Lake; strengthening the reclamation of soil erosion, controlling non-point source pollution; developing green Valley Industry and increase sewage disposal restrictions, fully implement the total amount of emissions control system; improving Basin water resources facilities, legal construction and operation management systems and mechanisms; strengthening the scientific research to enhance scientific and technological support to develop three-dimensional watershed ecological agriculture, strengthening the river basin water quality testing and regulatory system.
