The Conflicts And Coordination Between Public And Private Right Through The Difficulties In Selecting Proper Addresses For Urban Environmental Sanitation Facilities In Wenzhou

There are varieties of relations between public and private in human society: public law and private law, public field and private field, public interest and private interest, public right and private right. Among them, the most important is the relation between public right and private right. It is considered that public right is set to protect national and public interest (also called power), while private right is set to protect private interest. Strictly speaking, both public right and private right have the two aspects of power and right.Since there is complicated relation between public and private right, there must exist relation of conflict and coordination between public and private right. As for knowledge of it, there are both conservative and liberal theories. As one of public properties in the society, urban environmental sanitation facilities have difficulty in selecting proper addresses in their construction and reconstruction, that is difficulty in selecting addresses and the complicated relation of conflict and coordination between public and private right is included.Through research and analysis on the problem of difficulty in selecting proper addresses for urban environmental sanitation facilities in Wenzhou and together with comparison with similar circumstances at home and abroad, the thesis analyses and studies the relation of conflict and coordination between public and private right revealed in them with game theory. Therefore, a basic hypothesis is brought forward: The relation of conflict and coordination between public and private right in modern Chinese society is A RELATION OF CONFLICT AND COORDINATION BETWEEN PUBLIC AND PRIVATE RIGHT WITH CHINESE CHARACTERISTIC. On this basic hypothesis, the writer brings forward two major points:1. In modern Chinese society, the relation between public and private right is based on private right while public right exists on the commission of private right. However, the tradition of Public First still prevails in most Chinese.2. When tackling the relation of conflict and coordination or problem between public and private right, we shall, first, not only affirm the objective necessity and eternity of social conflict, but also recognize the objective existence and instability of social coordination and harmony; second, not only fully exert the positive role of social conflict, but also maximally reduce the negative role of social conflict; third, not only prolong the time of social coordination and harmony and keep the stability of social coordination and harmony, but also try to improve the level and quality of social coordination and harmony.
