Study On The Legal System Of Water Right Transaction Of Hei River Valley

Water is the foundation of natural resources,at the same time,as the economic resource it is strategic. With the socio-economic development, water resources around the world have become scarce. Located in northwest China's inland, the scarcity of water resources in Heihe River Valley is particularly evident. It has become a serious shortage of water resources in Heihe River Valley constraining socio-economic development and ecological and environmental protection "bottleneck" . The rationalizing of the allocation of such scarce resources will effectively alleviate the shortage. Water trading is an economic method to allocate the water resources, and economic instruments are often in need of legal framework to regulate the system.How to build our country's legal system of water rights trading, is one of the hot issues on the study of environmental law theory. In this paper, according as the former research achievements, on the basis of the sustainable development concept as a guide, using a combination of theoretical and practical approach, as a starting point to "both the old and the new water system" and "water-saving society in Zhangye City, analysis the basic theory of water transaction, define the connotation of water rights and water rights transaction. At the same time noting that the main body of water rights are only the specific water users. The Government is only the role of managers in the initial distribution of water borne, but the government can buy water rights back in order to involve in water right transaction as the civil man. To set up the legal system of water right transaction of Hei River Valley , the improvement of legislation is the premise ,a sound watershed management and regional management of the management system is the foundation, the building of a harmonious market mechanism of water rights transaction is critical. Concretely it is consist of the principle of water right transaction , the mechanism of the determination of the water price,the supervision and management mechanism and so on.
