Research For The Legalization Course Of Electronic Power Regulation

The science of administrative law, a department law that adjusts government administrative activities, studies problems of administration by law in law-governing countries in the aspects of organizations, behaviors, procedures and remedies of public administration. As the concept of public utilities regulation regulatory rised in China, it is meaningful in reality and of theory values that the electric power regulation, one of the important issues in public administration field,is brought into administrative law study.The electric power regulation is one of the important parts of public utilities regulation by Chinese government. Along with the gradual perfection of the electric power market and the exertion of market functions, its institutional targets and functions have been increasingly abundant and clear. The government should loosen the economic supervision in competitive link and strenghten the network-combining supervision in the course of natural monopoly, so as to ensure the fairness and orderly competition in the electronic power market.It is still unscientific somewhere in the legalization course of China's electronic power regulation, lagging behind that of developed countries. Since1990s, developed countries including the UK and the USA have been launching legal regulation system reform in the electronic power industry, thus to combine the legal regulation theories with specific regulation practice. Though the UK and the USA followed different paths to implement their market-oriented reform, there are still some common experiences as beneficial references for China:to guarantee independency of the regulatory institution by the legal system, to pay attention to the legal basis perfection of the electronic power regulation, to value the reform of regulation modes, and so on.Perfect laws and regulations are the premise and basis of effective regulation by electronic power regulatory institutions, and important system guarantee of smooth implementation of China's market-oriented reform in the electronic power industry. In the legalization process of China's electronic power regulation, the establishing of the watchdog as well as the related regulation legal system is still in its initial stage, not only any problems to be solved,but also no relatively mature experiences and perfect governmental formulation theories that are suital for China itself to follow. Therefore,it is needed to explore the following issues:How does the government implement its regulatory functions correctly? How does the government adjust the behaviors of the market participants as well as those of the regulatory participants? How does the government rationally take regulation legal measures to promote the electronic power industry?...
